Resumo Quais seriam os critérios para aferição do caráter desumano de atos praticados por governos contra a população civil durante uma pandemia? Para responder a esta pergunta, o presente ensaio, situado na interface entre o direito internacional penal e a saúde global, resgata um passado de práticas delituosas no campo sanitário para apontar, no presente, a determinação política e ideológica das respostas nacionais à Covid-19. A seguir, recorre ao pensamento de Hannah Arendt e Mireille Delmas-Marty para tratar do caráter evolutivo dos crimes contra a humanidade, como base para a análise de um caso paradigmático: a resposta brasileira à pandemia de Covid-19, cujas condutas governamentais são apresentadas à luz de elementos como contexto, actus reus e mens rea.

Resumo:O art. 28 da Declaração Universal dos Direitos do H o m e m dispõe que "todo homem tem direito a uma ordem social e internacional em que os direitos e liberdades estabelecidos na presente Declaração possam ser plenamente realizados'. Entendendo a expressão "ordem internacional" como ordem econômica internacional, o presente texto propõe u m a visão crítica da ordem jurídica e m vigor. A s normas e instituições que regulam as relações econômicas internacionais não vêm garantindo a ordem de que trata o art. 28. Sendo assim, propõe-se que sejam aplicadas as normas que c o m p õ e m o ordenamento jurídico dos Direitos Humanos, e m especial o direito ao desenvolvimento, no que se refere às relações econômicas internacionais, a fim de garantir u m a ordem econômica mais justa e e m que se realizem plenamente os direitos e liberdades previstos na Declaração. Abstract:The article 28 of the Universal Declaration on H u m a n Rights establishes that 'every man has the right to have a social and ínternational order in which every right and freedom of the Declaration could be totally assured" Considering the expression "Ínternational order'" as Ínternational economic order, this text proposes a criticai view of the law that regulates Ínternational economic relations since the mies and institutions which regulate this relations are not assuring the order referred in article 28. Under these conditions w e propose that the principies of human rights, specially the right to development, should be applied to regulate these relations, in order to warrant an economic order where justice prevails and the rights and freedoms established in the Declaration could be realized.
Considering the emergence of testimony as a fundamental source of history and shared memory after the Second World War, this article intends to discuss the role of testimony in Arendt's theory, considering, on the one hand, her criticism of the use of testimonies in the Eichmann trial and, on the other hand, the importance narrative, memory and metaphor acquire in her work. This discussion casts a lighton the role of testimonies inhistorical trialsconcerning crimes against humanity.Keywords: Testimony; Crime against humanity.Resumo: Considerando a emergência do testemunho como uma fonte privilegiada de história e memória posteriormente à Segunda Guerra Mundial, este artigo pretende discutir o papel do testemunho na teoria de Hannah Arendt, considerando, por um lado, suas críticas à abundância de testemunhos no julgamento de Eichmann e, por outro, a importância que a narrativa, a memória e a metáfora adquirem em sua obra. Essa discussão lança uma luzsobre julgamentos históricos envolvendo crimes contra a humanidade.
