RESUMO. O presente artigo propõe analisar, a partir da segunda Revolução Industrial, as transformações nos processos de trabalho, sobretudo nos modelos de gestão, que impactaram as relações produtivas e, por conseguinte, as relações sociais. A partir dessas relações, visa-se esclarecer, e até inferir, a emergência do empreendedorismo nos moldes atuais. Acredita-se que a gênese desse novo modelo de atuação, enaltecida pelo mercado, decorre das práticas da gerência científica, revisitadas aqui com base nos escritos de Harry Braverman. A gestão flexível, por sua vez, enseja, entre outras práticas, terceirizar parte de suas atividades, pela adoção da lean production. Constata-se, sob a orientação de autores como F. Chesnais e D. Harvey, que, inicialmente, houve forte interesse do capital em desestimular a atividade autônoma, classificando-a como insegura e precária. Atualmente, o discurso se inverte, isto é, o empreendedorismo é visto como a solução para a ausência de postos de trabalho e para a competitividade no mercado, em função da diminuição dos altos custos gerados pela legislação trabalhista. Palavras-chave: empreendedorismo, mundo do trabalho, terceirização, precarização, mercado. ABSTRACT. Entrepreneurship in the context of changes in the workplace. The present article proposes the analysis, beginning from the second Industrial Revolution, of the changes in the working processes, especially in management models, which affected relationships and therefore social relations. From these relationships, it seeks to clarify and to infer the emergence of entrepreneurship in the present. The genesis of this new acting model, praised by the market, is believed to be derived from scientific management practices, revisited here based of the writings of H. Braverman. Flexible management presents, among other practices, the outsourcing of part of its activities, by adopting the Lean Production. Thus, under the orientation of authors such as F. Chesnais and D. Harvey, it can be evidenced that, initially, there was a strong interest from the capital in discouraging autonomous/independent activity, classifying it as insecure and precarious. Nowadays, the discourse is reversed, i.e. entrepreneurship is seen as a solution for the lack of job posts and market competitiveness, due to the decrease in the high costs generated by labor legislation.
O objetivo deste texto é analisar, tendo como base alterações efetuadas no campo do Direito do Trabalho no Brasil nos anos de 1990, como o governo federal brasileiro, alterando a regulamentação jurídica sobre as formas de contratação e de uso da força de trabalho, colaborou diretamente para o avanço no país de formas de organização flexível do trabalho, oriundas de adaptações do chamado sistema toyotista. Através de um levantamento da literatura sobre o assunto e tomando o caso brasileiro como exemplo concreto, nosso intuito é contribuir para uma reflexão acerca dos papéis exercidos pelos Estados nacionais diante da emergência de oligopólios transnacionais privados e suas estratégias de exploração do trabalho em países periféricos, no contexto de uma economia capitalista globalizada.

Para tanto, foi realizada uma revisão de literatura sobre o assunto, a partir da qual se discute a possibilidade de aplicação do Direito Internacional Público a pessoas privadas visando responsabilização de um ente integrante da cadeia produtiva em país diverso daquele em que o dano foi causado, analisando a efetividade do princípio da Jurisdição Universal para o resguardo dos direitos humanos nas relações de trabalho. AbstractThe objective of this text is to reflect upon the context of International Public Law about the applicability of the Universal Jurisdiction principle towards the accountability in the state jurisdiction of transnational corporations that violate human rights in the productive chain, especially labor rights. Therefore, a literature review about the subject was realized, onwards it was discussed the possibility of applicability of the International Public Law on private persons, aiming the accountability of a member of a productive chain in a different country to which the damage was caused, analyzing the effectiveness of the Universal Jurisdiction principle to preserve human rights on labor relations.
