O presente trabalho debruça-se sobre a violência na contemporaneidade e a construção social do preconceito em relação à juventude em conflito com a lei. Desvela-se a socioeducação privativa de liberdade em suas premissas punitivas e tutelares que produzem um sistema de frágil resolutividade do atendimento. A proposta da Justiça Restaurativa é apresentada como uma possibilidade de avanço naquilo que preconiza o Estatuto da Criança e do Adolescente (ECA), por instituir práticas socioeducativas democráticas articuladas à rede de atendimento das políticas públicas da infância e juventude, oportunizando assim co-responsabilidades nas intervenções institucionais, na perspectiva de um Sistema de Garantia de Direitos para adolescentes privados de liberdade.
O artigo trata das inovações da legislação brasileira na política de atendimento socioeducativo aos adolescentes em conflito com a lei (SINASE), destacando avanços e desafios. Examina o papel da proteção social especial da Política de Assistência Social e do SUAS na execução das medidas socioeducativas. Tem como referência a pesquisa do Estadodo Maranhão (UFMA), articulada ao Mapeamento Nacional do Atendimento Socioeducativo (SDH/PR/CONANDA) e as reflexões da equipe da PUCRS. Afirma diferentes questões a serem enfrentadas pelo atendimento socioeducativo, tais como: o reduzido número e a baixa qualificação dos recursos humanos; a incipiente articulação entre atores do Sistemade Garantia de Direitos; a ausência de intersetorialidade entre as políticas públicas e o reduzido financiamento para as medidas socioeducativas.Palavras-chave: Atendimento socioeducativo, direitos humanos, Política de Assistência Social, adolescentes.ADOLESCENTS IN CONFLICT WITH THE LAW AND HUMAN RIGHTS: challenges to SINASE implementation.Abstract: The article discusses the innovations of Brazilian legislation on social educational care policy to adolescents in conflict with the law (SINASE), highlighting advances and challenges. Taking as reference the researchof the State of Maranhão (UFMA), articulated to the national Mapping of Social Educational care (SDH /PR/CONANDA) and the reflections of the team of PUCRS. Movimentos sociais de sexualidade e gênero: análise do acesso às políticas públicasResumo: Este artigo busca problematizar as formas com que os movimentos sociais de diversidade sexual e de gênero têm acessado as políticas públicas no Brasil. Para isso, analisa as especificidades e necessidades de reconhecimento de determinados grupos sociais historicamente vulneráveis que disputam a própria concepção de identidade. Nesta direção, são tematizadas as contradições presentes nesta disputa uma vez que os movimentos tanto avançam no reconhecimento identitário quanto reforçam estigmas e vulnerabilidades. Sob a perspectiva do método dialético-crítico, o artigo parte de situações concretas para uma análise mais ampla e teórico-reflexiva da realidade. Palavras-chave: Movimentos Sociais. Sexualidade. Social Movements of Sexuality and Gender: analysis of access to public policiesAbstract: This article analyzes the ways that social movements in support of sexual and gender diversity have accessed public policies in Brazil. It looks at the specificities and needs for recognition of specific social groups that have been historically vulnerable, and which dispute the very concept of identity. It analyzes the contradictions in this dispute given that the movements both advance in identity recognition and also reinforce stigmas and vulnerabilities. From a dialectical and critical perspective, the article uses concrete situations to conduct a broader theoretical and reflexive analysis of reality.
Embora sejam inegáveis as conquistas civilizatórias dos direitos humanos, seu reconhecimento e sua operacionalização têm demandado, além de lutas históricas, de modo cada vez mais intenso, a interpelação do Poder Judiciário. O fenômeno da judicialização da questão social ocorre em uma superposição de responsabilidades do Judiciário às demais instâncias da esfera pública. Esta forma de acesso à justiça se dá, via de regra, de forma individual e por um segmento seletivo de sujeitos - os que conhecem ou conseguem acessar este canal jurídico. Mas a efetivação dos direitos dependerá de outros fatores que não somente o seu reconhecimento, como a capacidade de atendimento e de financiamento à demanda apresentada. Diante deste quadro, discute-se este processo de efetivação de direitos que, ao privilegiar cada vez mais a via judicial, rebate no descomprometimento do Estado com o enfrentamento da questão social e na despolitização da esfera pública. Esta conjuntura adversa desafia os assistentes sociais a fazerem sentido ético-político em suas respostas profissionais às demandas de judicialização da questão social que se apresentam cotidianamente ao Poder Judiciário.
