Suatu perusahaan pasti membutuhkan tata kelola yang baik pula, dalam tata pemerintah biasa dikenal dengan konsep GG (Good Governance), GCG (Good Corporate Governance), GIG (Good Investment Governance). Pada dasarnya intinya adalah itikad baik untuk mewujudkan tata kelola yang baik, perlunya pembaruan sikap dan perilaku birokrasi dalam melayani kepentingan umum dan pelayanan kepada masyarakat. Di hukum perusahaan, perseroan merupakan salah satu badan usaha yang berstatus badan hukum. Salah satu tujuan perusahaan terbatas adalah mencari keuntungan. Penelitian ini bertujuan untuk; mengetahui dan menganalisis hubungan hukum dan penerapan good corporate governance dalam perusahaan dan penerapan prinsip-prinsip perusahaan dalam melaksanakan good corporate governance. Hubungan hukum dan penerapan GCG dalam perusahaan ini. Metode penelitian yuridis normatif. Yaitu suatu pendekatan yang mengacu pada hukum dan peraturan perundang-undangan yang berlaku.dan berdasarkan teori-teori dari berbagai sumber dan pendapat hukum. Berdasarkan hasil penelitian, penerapan Good Corporate Governance dalam perusahaan secara umum telah dijalankan dengan baik, tetapi apabila ada perusahaan yang hanya mengejar keuntungan besar tanpa memperhatikan kesejahteraan karyawannya maka tidak bisa dikatakan memenuhi atau melaksanakan prinsip Good Corporate Governance. Adanya prinsip GCG disini memberikan dampak positif bagi kelangsungan perusahaan dan karyawan dalam perusahaan tersebut perusahaan yang baik seharusnya didukung dengan system dan tata kelola perusahaan yang baik pula
Rapid internet-based technological developments have a tremendous impact on the production of electronic devices. The management of electronic waste or e-waste has become a problem for both developed and developing countries. In global scale, e-waste is the fastest growing waste, around 3-5% per year or about three times faster than normal household waste generation. Accordingly, Indonesian government classified e-waste as hazardous and toxic waste. Yet, Indonesia has not provided an adequate and comprehensive electronic waste management system. It is caused by lack of relevant environmental policy and regulations made specifically to handle e-waste management. This research aims to investigate the environmental regulations and the methods of managing e-waste and the role of the government in managing the recycling of e-waste by considering the intertwined interests to balance a clean environment in one side and economic growth on the other. By using an empirical juridical approach, the results showed that insofar the relevant regulation to cope with the problems is Government Regulation No. 101 of 2014 concerning Management of Toxic and Hazardous Waste. There are some provisions to manage e-waste in Indonesia such as by clinical processing methods, physical processing methods, biological processing methods and hazardous waste disposal method. However, in general electronic waste in Indonesia until now does not have clarity in management, regulation, and economic potential that can be worked on.
The study aims to review and revise the legal protection for consumers in ecommerce protection in Indonesia. Design/methodology/approach: The study was conducted by using normative researches to examine the provisions of Law Number 8 of 1999 concerning Consumer Protection Act, Law Number 11 of 2008 as amended by Law 19 of 2016 concerning Information and Electronic Transaction Law, Law Number 7 of 2014 concerning Trade regulates electronic system trading and disputes resolution through Online Dispute Resolution (ODR). Finding: The result showed that inadequate consumer protection, government regulations legal protection and disputes resolution arrangement. Implication: Practically to reviewing legal protection for consumers in e-commerce transaction requires an integrated collaboration between the government, business associations and consumer in Indonesia to realize protection among the parties.
AbstrackEntrepreneurs generally have assets in the form of movable objects, either in the form of land or buildings. Legal protection for holders of land rights certificates is not separated from human rights, because every person has the right to recognition of legal certainty, ha-land certificate is a strong but not absolute proof of certificate, meaning that the land rights certificate guarantees legal certainty for the owner as long as the certificate: a) is issued in the name of the rightful person, b) the right to the land is obtained by good title, c) is physically controlled, and d) no other party can prove otherwise. states that rights to registered land can be erased without the willingness of the holder and without compensation fund from the state because it was canceled based on the judgment of the court judge or the land was destroyed due to natural disasters or revoked rights in the public interest (other than compensation). Natural disasters in this case Likuifaksi is the process of changing the soil conditions of sand that is saturated with water due to increased pore pressure the price becomes the same as the total pressure due to the occurrence of the dynamic load, so that the effective voltage of the soil becomes zero. Likuifaksi is a phenomenon where the soil loses a lot of strength and stiffness for a short time, but even though liquefaction is the cause of a lot of damage, death, and large economic losses. In the event that a certificate of land rights or a building that is pledged as collateral to a third party in this case is a bank for business development purposes, it is necessary to have legal protection for those who own the land affected by liquefaction. Therefore, normative legal research is conducted using a juridical approach which starts from the analysis of secondary data with the support of expert opinion. Based on the results of the above research, it is concluded and suggested that countries willing to provide legal protection to holders of land and environmental rights certificates explicitly by optimizing the potential of natural resources, human resources, science and technology available through: -Repositioning acquisition procedures certificate of land rights with effective and efficient research of juridical physical and juridical data so that legal certainty is to protect holders of land rights certificates from the threat of abolishing land rights resulting from liquefaction.
Agen merupakan pihak yang bekerjasama dengan bank penyelanggara laku pandai yang menjadi kepanjangtangan Bank untuk menyediakan layanan perbankan kepada masyarakat. Laku Pandai merupakan program layanan perbankan tanpa kantor dengan memanfaatkan teknologi informasi dalam operasionalnya serta membutuhkan kerjasama antara bank penyelenggara dengan pihak ketiga yakni nasabah sebagai kepanjangan tangan bank untuk memberikan layanan perbankan pada masyarakat yang belum mengenal, atau kesulitan dalam menggunakan dan atau mendapatkan layanan perbankan. Terdapat beberapa permasalahan dalam penyelenggaraan Laku Pandai perihal peran bank penyelenggara dalam menentukan nasabah untuk membantu kegiatan perbankan dan berkenaan dengan peran bank penyelenggara dalam mengatur operasional agen Laku Pandai, juga permasalahan perihal perlindungan hukum terhadap nasabah yang melakukan transaksi perbankan melalui Laku Pandai.Penulisan karya ilmiah ini menggunakan metode yuridis empiris dengan pendekatan deskriptif kualitatif yaitu melakukan pengkajian dan pengolahan terhadap data penelitian dengan bertitik tolak pada aspek hukum normatif disertai dengan kajian teoritis hukum, yang didukung oleh fakta-fakta empiris di lapangan, dan bertujuan untuk menggambarkan secara sistematik, akurat, dan karakteristik mengenai populasi atau mengenai bidang tertentu. Laku Pandai dapat terselenggara dengan baik diperlukan upaya untuk memperbaiki atau menyediakan jaringan internet di lokasi agen Laku Pandai. Kerahasiaan data nasabah perlu aturan dan sanksi yang jelas mengenai kewajiban agen untuk memberikan perlindungan kepada nasabah agar nasabah tidak perlu merasa khawatir mengenai kebocoran data.
