The basic principle in Islamic law is to provide mashlahah to mankind, so that the main objective of a law requirement must be based on the maqashid sharia aspect, namely realizing benefits for humans both in world affairs and in the afterlife. Children as part of the foundation of religion because in the future they will become the successors of the ummah, Islam is here to provide protection for them, both maintaining their survival, proper education. Preventive measures must be taken to avoid bad behavior. The purpose of this study was to explore and refer to the concept of ihtiyat Imam Syafi'i regarding the suggestion of covering one's genitals with children. The research method used is library research and is qualitative in nature. Sources of data used in this study come from primary and secondary data. The result of this research is that the ability to cover the genitals of children is a form of precaution to avoid unwanted things
The implementation of health protocols during Covid-19 pandemic is very important to the prevention of virus transmission, but it had not been implemented optimally. Therefore, this study aimed to analyze the contribution of provisions in Islamic teachings and Infodemic to compliance with health protocols. The quantitative method was adopted with an observational study approach involving a total of 421 people. This sample was selected using the criteria of being Muslim, at least 18 years old, and willing to fill out a questionnaire online using the Google form. The results showed that the contribution of Islamic teachings in the form of Qada and Qadr belief and Covid-19 Infodemic had a positive effect on compliance with implementing the health protocols. Furthermore, the contribution of belief in Islamic teachings and Covid-19 Infodemic had a simultaneous positive effect on compliance with implementing health protocols. This study proved that religious and spiritual approaches can effectively increase community compliance in adhering to public health efforts.
Pada era global saat ini, kemudahan untuk mengakses internet merupakan suatu keniscayaan. Betapa tidak, pada genggaman setiap orang sudah ada gawai yang memudahkan akses untuk berselancar di dunia maya. Kemudahan ini ternyata memberikan pengaruh dalam kebiasaan mengekspresikan diri, yang dulu mengekspresikan diri melalui dunia nyata semakin tergerus oleh dunia maya. Dalam hal rumah tangga banyak kondisi dimana pasangan suami istri lebih banyak berkomunikasi lewat gawai yang menyebabkan lalai dari tanggung jawab masing-masing. Penelitian ini merupakan penelitian empris karena berkaitan dengan gejala sosial, dimana penulis menggunakan pendekatan kualitatif untuk mengumpulkan data. Hasil penelitian ini menunjukkan bahwa beberapa tahun terakhir ini, khususnya di Kabupaten Pangkep banyak yang bercerai akibat dari pengaruh media sosial. Pengaruh negatif dari media sosial mengakibatkan terjadinya perselisihan baik karena lalai, maupun cemburu terhadap istri atau suami karena terlalu akrab dengan media sosial. Salah satu faktor yang melatar belakangi timbulnya gugatan perceraian yang menarik adalah faktor penggunaan media sosial.
This research aims to analyze the use of the 'urf method in determining the safar limit as the area of debate among textualist and contextualist scholars. The problems proposed include (1) what are the opinion differences in terms of the nisab safar limit and (2) the use of the 'urf method in safar and its fiqh rules. This is library research by examining classical literature (turāś) that become monumental works of scholars. The results showed that the prevailing custom accommodated as 'urf is used as a method of discovering Islamic law. This method originated from the habits and understanding of a community group. 'Urf is implemented as a source of Islamic law when it fulfills strict requirements. Therefore, it is used as a method that can solve the problem but the Prophet Muhammad in several hadiths never explicitly stated the nisab safar. This is because it allows the 'urf to be used as one of the perspectives in determining the nisab safar as described by Ibn Taimiyah and Ibn Hazm. The method is expected to be a solution for Muslims living in the technology era and life sophistication.
This study discusses the main issues related to Sadd Dżariah's views in the Angalle Allo tradition in Taeng Village, Pallangga District, Gowa Regency. The purpose of this study, namely: This type of research is qualitative where qualitative research produces a descriptive data, so researchers collect data through interviews, observation and documentation. This research approach uses a sociological approach and shar'i approach. As for the informants in this study are community shops, as well as several communities directly involved in this adat procession. The data analysis techniques in this research process are: Data collection, data reduction, data presentation and drawing conclusions. As for Sadd Dżariah's view of the Angalle Alllo tradition which is included in the category of Acts which is basically permissible because it contains benefits, but allows for interpretations. What is meant by actions that are basically permissible are, carrying out good traditions in accordance with the teachings of Islam contained in QS Al-A'raf / 7 Paragraph 199, gathering together to eat where there is blessing and reciting verses of the Holy Qur'an ' where the reward is very useful for people who have died. While allowing the occurrence of the intended interpretations if in carrying out this tradition with the intention to send food to people who have died, making food in this tradition is mandatory so that it troubles the families of people who have died and other forms of activities that are not recommended in Islam.The implication of this research is to explain about Sadd Dżariah's view of the Angalle Allo tradition preserved by the people of Taeng Village to the present. The concept of mass organizations is discussed in the legal order in Indonesia. Ormas itself or community organization is an organization founded and formed by the community voluntarily based on common aspirations, desires, needs, interests, activities, and goals to participate in development in order to achieve the goals of the Republic of Indonesia based on Pancasila and the Constitution of the Republic of Indonesia. 1945. The mass organizations were then unilaterally disbanded by the government with reference to the Law on the dissolution of Social Organizations and Islamic Law concerning the dissolution of community organizations. The main problem of this paper is how the concept of Islamic mass organizations in the legal order in Indonesia, how the indications for the unilateral dissolution of mass organizations by the government and how to review positive law and Islamic law regarding mass organizations. Community organization is a forum formed by a group of people who have the same vision, mission, ideology, goals and have clear members. According to the author, in one of the main principles of fiqhiyyah which is very popular among Muslims, it says that "the leader's policy towards the people is related to the benefit" of this fiqh rule the author takes the understanding that the government dissolves the Indonesian Islamic Defenders Front Community Organization to protect the Unitary State of the Republic of Indonesia from the goal. The main goal is to make Indonesia a caliphate state. So it is clear that according to the author, the legal determination carried out by the government by dissolving the Islamic Defenders Front Community Organization does not conflict with Islamic Shari'ah because the government prioritizes its benefit in enacting this law, in order to mantain the integrity of the Unitary State of the Republic of Indonesia and the state ideology, namely, Pancasila which is considered final. in Indonesia. Indonesia's ideology of Pancasila became one of the main reasons the government dissolved the Islamic Defenders Front Community Organization. The establishment of a caliphate state which is glorified by this Community Organization is considered not in accordance with the Unitary State of the Republic of Indonesia whose ideology is Pancasila and highly respects diversity in the harmony of state life
Ide formalisasi syariah Islam dan penegakan daulah khilafah yang ingin diterapkan oleh Hizbut Tahrir Indonesia mempunyai implikasi untuk mengubah ideologi Negara Indonesia (internal) dan melawan ideologi barat yang masuk ke Indonesia. Lebih jauh, hal ini akan mempengaruhi hubungan antar negara yang berlaku saat ini. Tujuan ini akan sulit tercapai (dalam waktu dekat) oleh karena banyaknya tantangan diantaranya sistem demokrasi yang sudah lama dikembangkan di Indonesia, civil society (masyarakat madani) yang berwawasan moderat menginginkan substansi Islam, Peran lembaga MUI yang moderat sehingga dapat menangkal paham radikal dan sekuler.The idea of formalization of Islamic law and establishment of the Khilafah by Hizbut Tahrir Indonesia will have implications on changing the state ideology of Indonesia (internal) and resist western ideologies that came into Indonesia. Furthermore, it will affect the relationship between the state just like any today. This goal will be hard to achieve (in the near future), because of many obstacles, including; the democratic system has long been roots in Indonesia, the majority of Islamic mass organization have moderate vision and more likely to be on the substance of Islam not the formalization, not to mention, the Indonesian Ulama Council, which is still effective in counteracting the radical and secular ideas and movements.
Artikel ini membahas tentang konsep belis dalam tradisi perkawianan masyarakat desa Manga Mbaling Kabupaten Manggarai Timur. Jenis penelitian ini tergolong penelitian lapangan (field research) dengan menggunakan pendekatan syar’i. Adapun sumber data penelitian ini adalah sunber data primer yaitu tokoh adat, tokoh agama, tokoh pendidik dan sumber data sekunder yaitu Al-Qur’an, hadis, fiqh, buku, jurnal, dan literatur yang berkaitan dengan pembahasan skripsi ini. Selanjutnya, metode pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi. Lalu, teknik pengolahan data dan analisis data dilakukan dengan tiga tahapan yaitu: reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa: 1) Tata cara pemberian belis dalam perkawinan msayarakat Desa Nanga Mbaling. Dalam hal ini, pihak laki-laki mendatangi rumah orang tua perempuan untuk meminta persetujuan agar hubungan dengan anak perempuannya dapat direstui oleh kedua orang tua perempuan. Setelah itu, kedua orang tua laki-laki mendatangi rumah orang tua perempuan untuk membicarakan belis. Ketika sudah ditentukan waktu pemberian belis, maka pihak keluarga laki-laki menyiapkan belis yang sudah disepakati dan membawanya sesuai waktu yang telah di sepakati. Setelah tata cara pemberian belis tersebut dilakukan maka kedua pihak menentukan hari perkawinan. 2) Tokoh Adat, Tokoh Agama, dan Tokoh Pendidik tidak ada perbedaan pendapat mengenai belis. Dalam hal ini, belis tidak bertentangan dengan syariat Islam. Karena dalam tradisi belis di Desa Nanga Mbaling melakukan kesepakatan antara kedua belah pihak keluarga laki-laki dan keluarga perempuan dalam menentukan belis. Dengan kata lain, agama tetap berlaku dan belis tetap berlaku. Implikasi dari penelitian ini adalah: 1) Kepada masyarakat Desa Nanga Mbaling sebaiknya tidak mempersulitkan belis karena pada dasarnya perkawinan merupakan ibadah yang di permudah oleh ajaran agama. 2) Apabila pihak keluarga laki-laki tidak sanggup dengan penetapan belis oleh keluarga perempuan, maka pihak keluarga perempuan melihat kesanggupan pihak keluarga laki-laki dengan tata acara adat yang mempermudah.Kata Kunci : Belis, Tradisi, Perkawinan
