As provas têm papel importantíssimo para garantir o devido processo legal e, nesse tema, se destaca a inadmissibilidade das provas obtidas por meios ilícitos, de acordo com o que preceitua a Constituição Federal, no inciso LVI do artigo 5º, o que será objeto de estudo deste artigo, tendo como foco o direito processual do trabalho. Para tanto, busca-se por um método dedutivo e análise doutrinária compreender a natureza jurídica de tal dispositivo, passando pelas definições dos termos afetos à matéria da prova, apontando as diferenças entre provas ilegais, ilícitas e ilegítimas. A partir disso, o artigo aponta três teorias sobre a admissibilidade da prova ilícita e analisa o tema no direito processual do trabalho. Identifica-se a falta de disposição na CLT a respeito das provas ilícitas e, assim, por força do disposto no seu artigo 769, conclui-se que deve ser aplicado o direito processual civil. No entanto, questiona-se o fundamento pelo qual a fonte subsidiária seria o processo civil e não o processo penal quando a discussão é a prova ilícita, tendo em vista a fragilidade do trabalhador. Valeu-se, por conseguinte, de um método indutivo a fim de verificar na prática justrabalhista a utilização de documentos furtivamente obtidos como prova. Ao cabo de toda a exposição, espera-se obter um artigo que servirá de base para o fomento de outras discussões da prova ilícita no processo do trabalho, bem como conferir ao tema a relevância que merece exaltando a necessidade de respeitar o devido processo legal na Justiça do Trabalho.
