The existence of modern market in the area of tourism has been a wide concern in Bali. It is predicted that its existence can bring some negative impacts, especially eroding the existence of traditional market and reducing the right of work of traders in traditional markets. This study is aimed to investigate the right of works of traditional traders and to propose some efforts to strengthen them to be more competitive. This study used normative legal method, and the legal materials used included local government regulations on regulating both modern and traditional markets. Data were also collected through interview and field observation. The results showed that the existence of modern markets in the tourism sector has eroded the existence of traditional markets and diminished the right to work of traders in the traditional markets. In order to keep the existence of the traditional markets, strategies to strengthen model in the form of partnership business management, empowerment, and standardizing market services should be implemented. These strategies become the responsibilities to the government and other stakeholders, such as corporate, financial institutions, and communities.
Notary is an official authorized to make an authentic deed in accordance with the provisions of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Position of Notary (UUJNP). In carrying out his duties, the notary must uphold the moral values and professional ethics and must obey the applicable law so as not to make mistakes which will carry risks for the notary himself and cause harm to the community. Risks arising from negligence for the notary public in their duties are in the form of enforcement of sanctions both civil sanctions, criminal sanctions and administrative sanctions. This study analyzes criminal enforcement of notaries, as well as norm conflicts that arise between criminal decisions by judges against notaries and the applicable laws. The aims of this study is to find out the enforcement and sanctions against notaries in the realm of criminal law and notary office law based on case study of decision number 196 / pid.b / 2019 / pn Denpasar), and to determine the form of legal protection against notaries. This study uses the normative juridical method. The results of this study revealed that there are two elements in law enforcement and protection of notaries, namely preventive and repressive. Preventive in the form of supervision of notary practices and repressively is the imposition of sanctions. The form of legal protection for notaries is carried out by the Notary Supervisory Board and the Notary Honorary Council.
The president cannot regulate all areas of government independently, the government is formed such as the National Land Agency to create a land system in Indonesia. The land sector is related to Mortgage Rights because it is important where banks as creditors to the public need capital with objects being used as collateral by debtors. Technological advances brought changes, previously Mortgage was registered manually which was complicated and convoluted then gave rise to Electronic Mortgage Registration. The purpose of this research is to analyze the process of completing the cancellation of electronic mortgage registration according to the Minister of ATR/BPN Regulation Number 5 of 2020, and to understand the legal consequences of the cancellation of an electronic mortgage registration application according to the Regulation of the Minister of ATR/BPN Number 5 of 2020. The research method used is a type of empirical research using a sociological approach. The sources of legal materials for this research are primary and secondary sources. Data collection techniques used interview techniques, and recorded and documented data materials. This research discusses the process of completing the cancellation of registration and the legal consequences of canceling the application for registration of electronic mortgages according to the Minister of ATR/BPN Regulation Number 5 of 2020. The results of this research indicate that the settlement process in the event of cancellation of Electronic Mortgage Rights is by completing the conditions stipulated in Article 1 paragraph (1) Regulation of the Minister of Agrarian Affairs Number 5 of 1996 and the Legal Consequences of the Cancellation of the Application for Electronic Mortgage Rights, the debtor registers and pays PNBP again.
Consumers become objects of business activities to gain large profits. Stiff, consumers' position towards producers is not balanced because consumers are weak, so consumers need to get legal protection. Business actors often respond to events that harm consumers by cornering consumers and looking for consumer weaknesses. The method used in this writing uses nonnative legal research, namely examining problems using a regular basis in statutory regulations and supported by scholars' opinions in the literature. It is essential to explore the principle of absolute liability(strict liability)in consumerprotectionlaw and the provisionsof business actors' strict liabilityto consumers'protectionlaw. As for the conclusion, there is the principle of absolute liability (strict liability) in consumer protection law, namely that business actors are obliged to compensatefor the loss of goods and servicesthat consumers have purchasedforlosses sufferedby consumers, and if the business actor does negligence and failure to consumers can be given sanctions as stipulated in Law No. 8 of 1999 concerning consumer protection
The inheritance and the division of inheritance that is felt to be unfair is often a source of dispute. The disputes that occur can sometimes be resolved by making a peace agreement between the disputing parties. The peace desired by the parties is, of course, expected to end disputes/conflict and to provide legal certainty among those in dispute. However, sometimes peace agreements that have been made between those in dispute are disputed again in court. This study aims to examine the settlement of Balinese traditional inheritance disputes through a binding peace agreement between the parties make it. The method used in this study is a normative legal research, using a statute approach and a case approach. The result of this study showed that the settlement of Balinese indigenous inheritance disputes through a binding peace agreement of the parties that make it if the peace agreement is made based on the validity of the agreement as stipulated in article 1320 of the Civil Code, based on good faith as the principles in the law of the agreement, and must be made in the form of a notary deed is in accordance with the provisions for conciliation in book III of the Civil Code.
