Objective: This research was conducted to present considerations to the judge regarding the notary's right of refusal in the case of an examination (Study on Case Decision Number 1003 K/PID/2015) and the consequences related to the notary's right utilization according to the law on the notary's office and code of ethics in Indonesia. Methodology: This research adopted normative juridical law research, employing statute and case approaches. The materials obtained from the research findings were systematically collected and classified according to the subject matter and then qualitatively analyzed. Results: This research emphasized that the right of refusal in the position of a notary is contained in the notary oath of office, which prohibits disseminating the contents of the data. Regarding the consequences of the notary refusal, the notary will be discharged from witness obligations or a general testimony for the release of the notary from various demands related to all parties' interests. Applications of this study: The study provides a reference conceptualized into norms that can be accepted and implemented in society and become a moral guideline regarding the notary's right of refusal in the case of an examination. Novelty/Originality: This research concerns the notary's right of refusal in the examination context and its consequences. This study focuses on the judge's consideration investigation and its relation to the law on notary office and the notary code of ethics, which are relatively uncommon in Indonesia. Keywords: Notary, Right of Refusal, Law on Notary Office, Code of Ethics ABSTRAK Tujuan: Penelitian ini dilakukan untuk memberikan pertimbangan kepada hakim mengenai hak ingkar notaris dalam perkara pemeriksaan (Studi Putusan Perkara Nomor 1003 K/PID/2015) dan akibat yang terkait dengan penggunaan hak notaris menurut hukum tentang jabatan notaris dan kode etik di Indonesia. Metodologi: Penelitian ini menggunakan penelitian hukum yuridis normatif, dengan pendekatan undang-undang dan kasus. Bahan-bahan yang diperoleh dari temuan penelitian dikumpulkan secara sistematis dan diklasifikasikan menurut pokok bahasan kemudian dianalisis secara kualitatif. Hasil: Penelitian ini menegaskan bahwa hak ingkar jabatan notaris tertuang dalam sumpah jabatan notaris yang melarang penyebarluasan isi data. Mengenai akibat penolakan notaris tersebut, notaris akan dibebaskan dari kewajiban saksi atau keterangan umum untuk pembebasan notaris dari berbagai tuntutan yang berkaitan dengan kepentingan semua pihak. Aplikasi penelitian: Kajian ini memberikan acuan yang dikonseptualisasikan ke dalam norma-norma yang dapat diterima dan dilaksanakan di masyarakat serta menjadi pedoman moral mengenai hak ingkar notaris dalam hal pemeriksaan. Kebaruan/Orisinalitas: Penelitian ini menyangkut hak ingkar notaris dalam konteks pemeriksaan dan akibatnya. Kajian ini berfokus pada pemeriksaan pertimbangan hakim dan kaitannya dengan undang-undang jabatan notaris dan kode etik notaris yang relatif jarang ditemui di Indonesia. Salah satu bentuk aktivitas penipuan yang umum terjadi dalam dunia bisnis adalah penipuan investasi, yang seringkali merugikan masyarakat. Penipuan investasi terjadi ketika individu atau entitas mengumpulkan dana dari masyarakat tanpa izin dari otorisasi yang berkaitan. Penelitian ini akan membahas tentang pendirian sistem tanggung jawab pidana korporasi untuk kejahatan ekonomi, khususnya yang terkait dengan investasi. Fokus utamanya adalah memahami bagaimana entitas korporasi dianggap bertanggung jawab dalam kerangka hukum untuk aktivitas tersebut. Metode Penelitian ini mengadopsi pendekatan normatif, memandang kerangka hukum sebagai sistem norma yang terdiri dari prinsip-prinsip, peraturan perundang-undangan, preseden hukum, perjanjian kontraktual, dan ajaran doktriner. Penelitian ini mengungkapkan bahwa pengawasan terhadap aktivitas penipuan dalam korporasi dan penipuan investasi menyoroti peran penting yang dimainkan oleh regulasi hukum dan definisi dalam menjaga integritas pasar keuangan dan standar etika. Analisis ini menyoroti signifikansi besar yang ditempatkan pada penanggulangan perilaku penipuan dalam kerangka hukum, sebagaimana yang terlihat dalam ketentuan dalam Kode Pidana. Ketentuan hukum ini menekankan sifat sengaja dari penipuan, penggunaan identitas atau posisi palsu, dan potensi pemberian sanksi berat, termasuk penjara dan denda, yang digunakan sebagai pendekatan efektif untuk mencegah perilaku penipuan. Selain itu, pemeriksaan tanggung jawab pidana korporasi mengkonfirmasi bahwa perusahaan, yang berfungsi sebagai entitas hukum yang berbeda, memiliki kapasitas pertanggungjawaban hukum terkait tindakan yang dilakukan oleh perwakilan mereka, termasuk yang terkait dengan penipuan investasi. A prevalent form of fraudulent activities in the business sphere is investment fraud, which often affects unsuspecting members of the public. Investment fraud occurs when individuals or entities collect funds from the public without the required permits or authorizations. This study investigates the establishment of a system of corporate criminal liability for economic crimes, particularly those related to investments. The primary focus is to comprehend how corporate entities are held liable within the legal framework for such activities. This research adopts a normative approach, viewing the legal framework as a composite system of norms encompassing principles, statutory regulations, judicial precedents, contractual agreements, and doctrinal teachings. The investigation reveals that the scrutiny of fraudulent activities in corporate and investment fraud highlights the vital role played by legal regulations and definitions in upholding the integrity of financial markets and ethical standards. This analysis sheds light on the substantial significance attached to addressing fraudulent behaviors within the legal framework, as evidenced by the provisions in the Criminal Code. These legal stipulations underscore the deliberate nature of deception, the use of false identities or positions, and the potential imposition of severe penalties, including imprisonment and fines, all employed as potent deterrents against fraudulent conduct. Furthermore, the examination of corporate criminal liability confirms that corporations, functioning as distinct legal entities, possess the capacity for legal accountability regarding the actions undertaken by their representatives, including those related to investment fraud.

Policies in the implementation of health services at BPJS Health there are still obstacles experienced by patients and the hospital. Legal protection in health services aims to ensure legal certainty obtained by patients, so that patients avoid losses when receiving health services that should be optimally provided by health workers. The purpose of this study is to examine the implementation of the internal policies established by the Wangaya Hospital, Denpasar City in the implementation of BPJS Health services and to examine the legal protection for patients in BPJS Health services at Wangaya Hospital Denpasar City. This study uses empirical legal research methods, using the approach to legislation, analysis of legal concepts and facts. The research location is at Wangaya Hospital, Denpasar City. The results of this study showed that the implementation of internal policies at Wangaya Hospital, Denpasar City in providing BPJS Health services, namely with the authority of hospitals to be able to formulate and implement hospital regulations (hospital by laws) which contain general hospital services policies that support corporate governance and good governance, clinical governance. In the implementation of BPJS Health at Wangaya Hospital, Denpasar City, there are obstacles, such as: obstacles in claiming, technical, procurement of medicines that are not available or not yet available at distributors. Meanwhile, legal protection in BPJS Health services where patients are BPJS Health participants to be able to fulfill their rights as participants or patients. Patient rights have been regulated in the Medical Practice Law, Health Law, and Hospital Law. Legal protection is provided by the BPJS Health and the Hospital, namely by establishing a PIC (Personal in Change) which functions to accommodate handling patient complaints or related to BPJS Health services.
