The paper analyzes actual data of talk-in-interaction in a conflict situation and proposes to investigate the role of purpose clauses in the argumentative talk of the participants in a hearing in the Special Criminal Court. The work proposal intertwines the Functionalist dimension to the perspective of Interactional Sociolinguistics, in order to examine the interface between grammar and interaction. Theoretically, discourse tools are employed, finding in the sequential analysis of the argumentation in talk shifts their focus. This perspective is joined with a functionalist syntax approach in the identification and description of the use of purpose clauses (DIAS, 2001) in the arguments of the participants of the audience investigated. In the argumentative analysis, the components of the argumentation proposed by Schiffrin (1987) are used: position, dispute and sustentation. In this qualitative case study, we follow the trajectory of the argumentative process in a case of verbal aggression between two women, and show specifically how hypothetical purpose clauses are linked to the support of positions in this institutional context.
RESUMO -Este trabalho tem como objetivo investigar os papéis desempenhados por uma juíza em uma Audiência no Juizado Especial Criminal de uma cidade da Zona da Mata de Minas Gerais, contexto jurídico no qual são julgados crimes e contravenções penais de menor potencial ofensivo, aos quais cabem penas menores de dois anos. Os dados mostram que, além dos papéis orientados para a realização de tarefas e metas institucionais inerentes a esse tipo de evento discursivo, outros papéis, orientados para o controle da interação nesse cenário institucional, são salientados. Os resultados da análise permitem concluir que o hibridismo de papéis, no contexto profi ssional de Audiências Preliminares Criminais no Brasil, além de ser predominantemente orientado para as partes, vítima e réu, encontra-se imbricado à criatividade exigida para a execução do mandato institucional deste tipo de atividade de fala.Palavras-chave: papel, hibridismo de papéis, interação institucional, audiência criminal.ABSTRACT -This paper aims to investigate the roles performed by a professional judge in a Special Criminal Court Hearing in a city of Zona da Mata in Minas Gerais. In this law context, crimes and misdemeanors are tried and charged with sentences under two years. The data show that, besides the roles oriented toward the achievement of institutional goals and tasks which are inherent in this type of event discourse, other roles are highlighted, which are oriented toward controlling the interaction in this institutional setting. Este trabalho tem como objetivo analisar o uso de ameaças na fala da conciliadora em uma audiência preliminar no Juizado Especial Criminal de uma cidade de Minas Gerais. Para tanto, adotam-se os referenciais teórico-metodológicos da Análise da Conversa (SACKS; SCHEGLOFF; JEFFERSON, 1974; DREW; HERITAGE, 1992) e da Sociolinguística Interacional (GUMPERZ, 2002[1982], 1999; GOFFMAN, 1974, 2002[1979]). O trabalho é de cunho qualitativo-interpretativo (DENZIN; LINCOLN, 2006), e os dados foram transcritos seguindo as convenções do modelo Jefferson (LODER, 2008). A geração e a análise dos dados foram auxiliadas pelo conhecimento etnográfico obtido não só por meio de entrevistas, diários de campo, conversas informais etc., como também pela convivência etnográfica da pesquisadora como integrante da comunidade e conhecedora da cultura e dos costumes. Os resultados mostram que as ameaças são do tipo condicional diretivo-comissivo, estruturadas como silogismo formal, e atuam no cumprimento do mandato institucional (MAYNARD, 1984) para dar continuidade às tarefas previstas para aquela situação de fala.
Este artigo analisa a argumentação de profissionais que atuaram em um processo criminal militar sobre uma prova audiovisual. A hipótese era a de que a argumentação não seria satisfatória, dadas as peculiaridades dessa prova e a ausência de um tratamento específico no Brasil. A partir da interface com a linguística textual, desenvolveu-se pesquisa de cunho empírico, qualitativo e descritivo, baseada no método do estudo de caso para a análise das marcas linguísticas e do direcionamento da força dos argumentos apresentados. Tal análise permitiu inferir a preferência na argumentação voltada ao vídeo, a discrepância entre a natureza demonstrativa na legitimação e substantiva na valoração dessa prova, a ausência de argumentação sobre os elementos multimodais e a incidência da teoria da testemunha silenciosa. A hipótese restou confirmada, concluindo-se pela necessidade de maior alfabetização digital dos profissionais do direito para lidar com a complexidade dessa espécie de prova.
