Os embargos de declaração são modalidade específica de recurso, o qual está disciplinado nos arts. 1.022 e ss. do CPC/15, cuja razão de ser é se opor, contra qualquer decisão judicial, especificamente em virtude da existência de vícios resultantes de obscuridade, contradição, omissão e erro material, a fim de que sejam esclarecidos, eliminados, supridos ou corrigidos, a depender do caso. Sucede-se que este recurso foi estudado e analisado no que diz respeito à sua eficácia em decisões prolatadas no âmbito do Tribunal de Justiça do Distrito Federal e Territórios, de modo que, para tanto, procedeu-se ao levantamento de dados na plataforma do 1º grau do PJe, quanto ao não conhecimento ou conhecimento e provimento ou não provimento de ações ajuizadas durante o ano de 2018. Desta maneira, foi estabelecida uma amostra da população por meio de cálculo de amostragem, a fim de obter os diversos cenários processuais possíveis no momento pós-oposição dos embargos. Por fim, constatou-se a proporcionalidade entre a oposição de embargos e a interposição de apelação, quando aqueles são conhecidos e não providos. Além disso, verificou-se se há alguma relação entre o juízo de retratação dos embargos e da apelação. Assim, os resultados corroboram para o entendimento de que os embargos são dotados de média eficácia, em virtude de significativos índices de conhecimento e provimento total ou parcial.
