Revolusi industri 4.0 mengonvergensikan antara manusia dan manfaat teknologi informasi dan komunikasi dalam kehidupannya. Bagaikan mata uang dengan dua sisi, teknologi informasi dan komunikasi dapat memberikan dampak positif atau justru negatif bagi manusia. Hoax merupakan salah satu dampak negatif atas pemanfaatan teknologi informasi dan komunikasi. Fenomena problematik ini diperparah dengan adanya kemajuan penggunaan teknologi informasi dan komunikasi di belahan dunia dari berbagai lapisan masyarakat yang satu di antaranya adalah remaja. Penulisan berdasarkan pada kegiatan pengabdian yang bertujuan untuk: (i) menjelaskan hoax dalam perspektif literasi digital dan hukum; dan (ii) menjelaskan edukasi anti-hoax untuk remaja desa. Hasil menunjukkan bahwa: (i) hoax berkaitan dengan literasi digital dan hukum. Pengetahuan dan pemahaman tentang hoax dan pengaturan hukumnya yang baik dapat menjadi penanggulangan penyebaran hoax di era digital; (ii) remaja Desa Kajar diberikan edukasi anti-hoax seperti cara mengetahui kebenaran informasi dan ketentuan hukum tentang hoax. Anti-hoax Education for Rural Youth: Digital and Legal Literacy Perspectives The industrial revolution 4.0 converges between humans and the benefits of information and communication technology in their lives. Like a coin with two sides, information and communication technology can positively or negatively impact humans. Hoax is one of the negative impacts of information and communication technology use. This problematic phenomenon is exacerbated by the progress in the use of information and communication technology in various parts of the world from various walks of life, one of which is youth. The writing is based on community service activities that aim to: (i) explain hoaxes from the perspective of digital and legal literacy; and (ii) explain anti-hoax for rural youth. The results show that: (i) hoaxes are related to digital and legal literacy. Knowledge and understanding of hoaxes and good legal arrangements can be a countermeasure for the spread of hoaxes in the digital era; (ii) the youth of Kajar Village are given anti-hoax such as how to find out the truth of information and legal provisions regarding hoaxes.
Dalam negara hukum, terdapat prinsip-prinsip yang senantiasa dipegang teguh dalam penyelenggaraan negara. Prinsip ini sebagai alat untuk mencapai tujuan negara sebagaimana tertuang dalam konstitusi. Tulisan ini bertujuan untuk menjelaskan mengenai diskursus prinsip negara hukum demokrasi atas permasalahan konstitusionalitas Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (IKN). Hasil menunjukkan bahwa adanya permasalahan formil dan materiil dalam pembentukan undang-undang a quo. Diskursus prinsip negara hukum demokrasi menjawab permasalahan ini yakni dengan menguji Undang-Undang IKN ke Mahkamah Konstitusi, merumuskan ulang mengenai Ibu Kota Negara dalam Undang-Undang IKN menjadi provinsi, perlu adanya Dewan Perwakilan Rakyat Daerah, dan adanya mekanisme pemilihan kepala otorita.
Legal protection for the community to obtain rights and recovery of the situation is one of them taken by settling civil cases through the courts. During the times and the adjustment of existing conditions, the Supreme Court issued a responsive and progressive law with the enactment of Supreme Court Regulation Number 1 of 2019 so that the public could obtain essential justice based on the principles of fast, simple, and low-cost justice. The aims of this study are: (i) knowing the legal culture in the implementation of e-court as a reflection of the problems of law enforcement; and (ii) reconstruction of legal culture regarding case administration and court proceedings electronically. The author uses empirical juridical research methods. The results of the study show: (i) e-court based court legal culture is not yet optimal. Village communities seeking justice (non-advocates) at the Religious Courts and District Courts of Semarang Regency tend to prefer conventional registration and trial over e-courts; and (ii) the reconstruction of the legal culture community is carried out using e-court socialization education to all advocates, providing educational media to non-advocates, and providing information about administration and trials electronically through notification letters to the district head .Through this, it will create a legal culture that supports the implementation of e-court so that fair law enforcement can be achieved.
Today, online gender-based violent crime is a global crisis phenomenon. This crime that takes human rights is spreading like cancer cells because it is in line with the development of the world which is closely related to advances in information and communication technology. This condition then places humans to have an attachment to these entities in everyday life. The coherence is the increasing incidence of these crimes that have transcended the scale of the crisis through the dimensions of cyberspace that give rise to complexity. Therefore, it is necessary to strengthen the legal system that focuses on victims of online gender-based violence. The aims of this paper are: (i) to explain online gender-based violence as a crime in cyberspace; and (ii) describe the framework for strengthening the legal system to combat online gender-based violence in Indonesia. The author uses a normative juridical writing method. The results show that: (i) online gender-based violence is part of crime in cyberspace; and (ii) the framework for strengthening the legal system is carried out through a 3-point approach, including aspects of the system, legal culture, and access to justice. These three aspects are carried out as a form of preventive and repressive efforts so that online gender-based violent crime law enforcement can work effectively. In addition to empowering women and reducing the number of crime cases, through this comprehensive framework, crime victims can obtain legal protection so that their rights can be fulfilled.
<p>Konsep negara hukum, hukum lah yang menjadi panglima dalam penyelenggaraan negara. Oleh karenanya, negara menaruh perhatian dari proses pembentukan peraturan perundang-undangan hingga pelaksanaannya. Undang-Undang Nomor 12 Tahun 2011 menjadi landasan pembentuk peraturan perundang-undangan untuk membentuk peraturan perundang-undangan yang baik. Tujuan penelitian ini adalah: (i) menjelaskan putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020; dan (ii) menunjukkan ketidakpatuhan pembentuk peraturan perundang-undangan terhadap putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 dengan dibentuknya Peraturan Presiden Nomor 113 Tahun 2021. Penulis menggunakan metode penelitian yuridis normatif. Hasil penelitian menunjukkan: (i) putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 merupakan putusan atas permohonan pengujian formil Undang-Undang Nomor 11 Tahun 2020 terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang pada amar ke-7 menyatakan menangguhkan segala tindakan atau kebijakan yang bersifat strategis dan berdampak luas serta tidak dibenarkan pula menerbitkan peraturan pelaksana baru yang berkaitan dengan undang-undang <em>a quo</em>; dan (ii) ketidakpatuhan pembentuk peraturan perundang-undangan ditunjukkan dengan disahkannya Peraturan Presiden Nomor 113 Tahun 2021 sebagai peraturan pelaksana baru yang berkaitan dengan Undang-Undang Nomor 11 Tahun 2020. Perlu adanya kepatuhan pembentuk peraturan perundang-undangan karena selain sebagai refleksi cita negara hukum yang baik juga untuk mencapai hakikat tujuan negara dan hukum.</p>
