La Jurisdicción Especial para la Paz (JEP) es el componente principal del Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR) establecido en el Acuerdo Final de Paz. La JEP responde a un modelo de justicia restaurativo que privilegia la verdad y la reparación sobre el castigo, entendido en su tradicional sentido retributivo. Sin embargo, para sus detractores, este modelo de justicia favorece la impunidad y la revictimización. El presente artículo analiza el fundamento teórico de la justicia transicional y el contexto sociopolítico que permitió el surgimiento de la JEP en Colombia. Se concluye que la justicia transicional es un producto histórico que recoge y sistematiza la experiencia de muchos países en momentos de transformación política y que fue adoptado en Colombia ante la imposibilidad de llegar a la paz por la vía militar. Con todo, su éxito dependerá de la transformación de una arraigada cultura jurídica de justicia retributiva.
Las personas LGBTI son víctimas de diferentes tipos de violencia que pueden constituir delitos ordinarios, crímenes de prejuicio y crímenes de lesa humanidad. El propósito de este artículo es analizar las debilidades y fortalezas del marco normativo de investigación y juzgamiento de las violencias contra este tipo de población cometidas en el conflicto armado interno en Colombia, según las anteriores categorías. Se recurre al método dogmático jurídico con revisión doctrinal y análisis documental. El estudio concluye que formas de violencia contra personas LGBTI como asesinato, violencia sexual, tortura, desplazamiento y desaparición forzada en el conflicto armado deben investigarse y sancionarse como crímenes de lesa humanidad, a pesar de que tal tipificación no esté contemplada en el derecho penal doméstico.

Un acercamiento al liberalismo del siglo XIX a través de las ideas de Florentino González Resumen El presente trabajo tiene por objeto hacer un análisis crítico de los principios liberales imperantes en la Colombia postcolonial del siglo XIX, principalmente a través de la obra de Florentino González. En cuanto a su alcance, el artículo aborda diferentes facetas del liberalismo de la época, tales como la relación entre costumbre y ley, la separación Iglesia-Estado, la tensión federalismo-centralismo, el sufragio universal y la democracia ilustrada, a la luz de lo que actualmente entendemos por principios liberales. Como resultado se encuentra que el liberalismo del siglo XIX se caracterizó por servirse de un argumento civilizador para segregar y discriminar a la mayor parte de la población.
