Hibah (inter vivos) is relatively one of the important topics in Islamic wealth management. Despite its importance, previous studies found that the practice of hibah remains at a low level in comparison to waqf and zakat. Therefore, this study is conducted to assist academics to get started on developing a theoretical framework and to instruct researchers who are just starting in hibah-research on which journals and authors to look to for further analysis on this phenomenon. To do so, this study uses the SCOPUS and Web of Science (WoS) databases to identify the research fields with the highest output of research, the nations, and languages that have produced the most hibah-related research, the year that hibah-research first began, the journals that publish the majority of research, and the most pertinent authors with hibahrelated publications. The finding shows that hibah-related research is indeed less published in the two databases. Therefore, researchers on this topic should publish more in the future to provide more reference to those who want to take benefits from academic writing.

Products with the concept of hibah amanah are growing in the Muslim property planning industry in the country. Hibah amanah is an alternative mechanism for Muslims to plan and manage property division effectively. However, there is confusion in the community about the implementation of this product. Therefore, this study aims to analyze the confusions that often arise in the community about hibah amanah products. This study is qualitative research based on a narrative study. The data was collected from articles related to hibah amanah. All articles were analyzed using content analysis to achieve the objectives of the study. The results of the study found that there is confusion in the hibah amanah product, especially regarding the concept of hibah and trust used, namely aqad hibah ruqba, the stipulation in aqad hibah, ownership and delivery of goods, acceptance after death, hibah in secured property, aqad in trust, acceptance of wages in trusts and combinations of trust contracts in aqad hibah. Therefore, there needs to be a specific study to look at this problem through the lens of Islamic law so that commercialized hibah amanah products can be made and applied by the community without any doubt.

Pemikiran tentang perlindungan pihak berkontrak memang wujud dalam Islam dan undang-undang kerana menjadi suatu keperluan untuk memberikan keadilan kepada pihak yang lemah dalam berakad, seperti pembeli. Mutakhir ini, banyak kes yang melibatkan penipuan dan eksploitasi terhadap pembeli dan pengguna dalam urusan jualan barang disebabkan oleh ketidakseimbangan kuasa berunding antara kedua-dua belah pihak dalam berakad. Oleh sebab itu, usaha melindungi pihak yang lemah dalam berakad amat wajar kerana dapat memberikan keutuhan kepada kontrak yang dimeterai. Ulama telah menggariskan peraturan tertentu untuk melindungi pihak berkontrak pada peringkat pascaakad. Dalam undang-undang yang berkaitan dengan kontrak juga, terdapat pelbagai kaedah yang boleh digunakan oleh pihak yang terkilan dalam berkontrak untuk menuntut haknya agar dihormati oleh pihak lain. Antara kaedah yang dimaksudkan termasuklah remedi pilihan sendiri. Makalah ini membincangkan aspek remedi pilihan sendiri yang boleh dituntut oleh pihak yang terkilan selepas akad menurut Islam dan undang-undang. Kajian ini berbentuk kajian perbandingan dengan menganalisis pandangan dari sudut Islam dan undang-undang yang berkaitan dengan remedi pilihan sendiri untuk melindungi dan memberikan keadilan sewajarnya kepada pihak yang lemah dalam berakad. Hasil kajian ini mendapati bahawa wujud beberapa perbezaan pandangan dari segi konsep dan falsafah antara Islam dengan undang-undang kontrak moden tentang bentuk remedi pilihan sendiri. Sesetengah konsep remedi yang terdapat dalam Islam tidak didapati dalam undang-undang moden. Namun begitu, terdapat persamaan dari segi matlamat umum antara Islam dengan undang-undang kontrak moden, iaitu untuk menjamin keadilan dan keseimbangan kuasa berunding antara pihak yang berkontrak. Dapatan daripada kajian ini diharap dapat menyumbang kepada usaha menambah baik aspek perlindungan pihak berkontrak pada masa kini yang semakin kompleks dan rencam.
