Socialização e regras de conduta para adolescentes internados

Abstract

Sempre que a análise da punição se concentra no conjunto de práticas e instituições que integram a resposta estatal aos crimes cometidos por crianças e adolescentes, uma espécie de conversão se torna necessária: adolescentes não cometem crimes, mas "atos infracionais"; não são punidos, mas "responsabilizados"; não recebem penas, mas "medidas socioeducativas". No caso brasileiro, tal diferenciação terminológica não apenas responde à definição legal da inimputabilidade penal de pessoas com idade inferior a 18 anos, mas reflete também o investimento normativo na afirmação e na defesa de uma ruptura entre o modo de funcionamento da justiça para a infância e adolescência e aquele para adultos. Esse movimento faz emergir um fenômeno particular, objeto específico de pesquisas e alvo de práticas e instituições especializadas. Trata-se de uma especialização -teórica e prática -resultante da emergência histórica e da cristalização cultural da particularidade desses sujeitos (a criança e o adolescente) que demandaria medidas também específicas (cf. Ariès, 2006; César, 2008). A infância e a adolescência são tidas como fases de formação e desenvolvimento que pressupõem indivíduos incompletos, mais vulneráveis ao meio em que vivem e mais suscetíveis a medidas corretivas.A definição de punição é mediada pelo processo mais amplo de criminalização da pobreza (cf. Coelho, 1978) e se expressa na vinculação legal e institucional entre medidas punitivas e medidas de assistência social.
