Geographical indication (“G.I”) is a designation that indicates the unique and original qualities of a product originating from a particular geographical location. The human factor (Indigenous people) plays a big role in the creation of a geographical indication, in addition to environmental and geographical factors. Preserving the intellectual property rights of Indigenous People through G.I will result in a more advantageous impact on their community, especially for those who rely on G.I products for their livelihood. This not only safeguards their cultural identity and dignity but also enables them to benefit from the commercial value of their intellectual property, whether through direct sales or licensing agreement. Indonesia have ratified the International regulation and issued Law No. 20 of 2016 concerning Trademark and Geographical Indications. The purpose of this research is to evaluate and examine the current status of geographical indication protection in Indonesia and assess if it is being implemented in line with the expectations set forth in the relevant legislation based on the supportive data and previous cases. The paper will then illustrate the impact and advantages for Indigenous communities in preserving and registering their geographical indications, using examples of successful geographical indication registrations from around the world. The type of research method is normative while the approaches employed are statutory and conceptual approaches with an analytical and descriptive research design. Based on the research conducted, the legal framework for protecting G.I has been sufficiently established but the government has not fully prioritized based on the data presented and cases documented. This paper will present several recommendations for the government and other relevant stakeholders.

Geographical Indication (GI) is one of the Intellectual Property Rights features. In this instance, one component that needs to be highlighted is its registration. Unfortunately, there are several infringements of Indonesian GI exist, such as Indonesian product registration being claimed by foreigners or outsiders. This article examines the legal protection of Geographical Indications based on Indonesian Legal Instruments and the law of outsiders parties and the international’s rule in Geographical Indication dispute settlement among countries. This article uses normative juridical research methods with a descriptive-analytical approach using national and international laws and relevant regulations to its issues. The findings revealed that protecting Geographical Indications in the International domain often causes polemics due to the need for firmness regarding the International Agreements’ substance. The arrangement of Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) merely requires legal provisions for each country in protecting Geographical Indications. Consequently, each country has fundamental different legal for protecting GI, and the legal uncertainty in International Agreement raises new issues.

Penulisan ini bertujuan untuk menganalisis dasar hukum pembentukan serta pentingnya perlindungan hukum terhadap Organisasi Masyarakat Perlindungan Indikasi Geografis Kopi Kintamani. Metode hukum normatif digunakan pada studi kali ini berdasarkan peraturan perundang-undangan dan studi kepustakaan. Hasil studi menjelaskan bahwasanya Kopi Kintamani merupakan Indikasi Geografis yang pertama terdaftar di Indonesia. Indikasi Geografis Kopi Kintamani dikelola melalui organisasi Masyarakat Perlindungan Indikasi Geografis (MPIG). Organisasi MPIG sangat berperan penting dalam menjaga dan melindungi keberadaan Indikasi Geografis Kopi Kintamani. Organisasi MPIG telah dibentuk berdasarkan surat keputusan Bupati Bangli, namun menurut Undang-Undang Nomor 20 Tahun 2016 belum memuat ketentuan tentang perlindungan hukum bagi organisasi tersebut. Pemberian perlindungan hukum bagi organisasi MPIG adalah sebagai bentuk kepastian hukum untuk menghindari terjadinya pelanggaran hukum terhadap organisasi tersebut mengingat peran pentingnya dalam perlindungan Indikasi Geogragis Kopi Kintamani. Maka dari itu, pemerintahan daerah perlu membentuk kebijakan-kebijakan daerah dalam hal perlindungan Organisasi MPIG. This writing aims to analyze the legal basis for the establishment and the importance of legal protection for the Kintamani Coffee Protection Community Organization. The normative legal method used in this study is based on legislation and literature study. The results of the study explain that Kintamani Coffee is the first registered Geographical Indication in Indonesia. Geographical Indications Kintamani coffee is managed through the Geographical Indication Protection Society (MPIG). The MPIG organization plays an important role in maintaining and protecting the existence of the Kintamani Coffee Geographical Indications. The MPIG organization has been established based on the Bangli Regent's decree, but according to Law Number 20 of 2016 it does not yet contain provisions on legal protection for the organization. The provision of legal protection for the MPIG organization is a form of legal certainty to avoid legal violations against the organization considering its important role in protecting the Kintamani Coffee Geographical Indications. Therefore, local governments need to form regional policies in terms of protecting the MPIG Organization.
