ÖR Das „intendierte Ermessen“

Abstract

Die gesetzliche Programmierung der Verwaltung korreliert mit der gerichtlichen Kontrolldichte. Ist eine Behörde ermächtigt, nach ihrem Ermessen zu handeln (vgl. § 40 VwVfG), beschränkt sich die verwaltungsgerichtliche Kontrolle auf die Ermittlung von Ermessensfehlern (vgl. § 114 S. 1 VwGO). Das von der Rechtsprechung entwickelte »intendierte Ermessen« hat Konsequenzen für die Ermessensfehlerlehre, reduziert zugleich aber auch die behördliche Begründungspflicht ( § 39 I 3 VwVfG). I. Steuerung der Verwaltung durch gesetzliche Rechtsfolgeanordnung 1. Gebundene Verwaltungsentscheidung und Ermessensentscheidung Im demokratischen Rechtsstaat ist die Verwaltung (»vollziehende Gewalt«) an Gesetz und Recht gebunden (Art. 20 III GG). Art und Dichte der gesetzlichen Programmierung des Verwaltungshandelns sind durch die jeweilige Normstruktur und den Norminhalt vorgeprägt 1 . Die administrative Rechtsetzung 2 ist naturgemäß mit Gestaltungsoptionen verbunden. Über Gestaltungsaufträge verfügt die Verwaltung auch im Rahmen final strukturierter Rechtsvorschriften; die wichtigsten Beispiele hierzu finden sich in der räumlichen Gesamtplanung bei der örtli-chen Bauleitplanung ( § 1 VII BauGB) 3 und auf dem Gebiet der Fachplanung im Planfeststellungsrecht ( § § 72 ff. VwVfG) 4 . Diese Komplexe können nachfolgend außer Betracht bleiben. Handelt eine Verwaltungsbehörde auf der Grundlage einer konditional strukturierten Rechtsvorschrift nach dem »WennDann-Schema« (Tatbestand ‫-‬ »Wenn«, Rechtsfolge ‫-‬ »Dann«), hängt der administrative Entscheidungsspielraum in der Regel von der gesetzlichen Ausgestaltung der Rechtsfolge ab 5 . A scheme for the preparation of a polarised antineutron beam
