V poslední době vzrostl alespoň mezi katolickými autory zájem o kategorii společného dobra. Důvody tohoto zájmu jsou mnohé: některé lze hledat ve vnitřní dynamice akademického diskursu, jiné souvisí s kulturním pohybem západních společností či s výzvou pandemie, jíž čelil celý svět. Tváří v tvář otázce očkování se představitelé katolické církve neváhali dovolávat nutnosti pečovat o společné dobro. Příklon západních společností k individualismu s sebou zase přinesl nejrůznější problematické společenské jevy -např. epidemii samoty, již doprovází pocit bezesmyslnosti života a ztráta schopnosti něco nadšeně vytvářet s ostatními v rámci církve či občanské společnosti. Opřu se přitom o dva přední myslitele posledních desetiletí, Johna Rawlse a Johna Finnise, čelní představitele liberální a aristotelsko tomistické intelektuální tradice. 1 Volba těchto tradic není arbitrární, neboť právě v aristotelsko tomistické tradici má tento pojem svůj původ a vrchol jejího způsobu uvažování o společném dobru můžeme najít u sv. Tomáše Akvinského a jeho předchůdců a následovníků. 2 Moderní (tj. liberální) myšlení je užívání pojmu společného dobra mnohem zdrženlivější; ne všichni moderní filosofové se ho dovolávají a ti, kdo tak * Text vznikl v rámci grantu Lidská práva a welfarismus (GA23 06790S).

MacIntyre’s ‘liberal’ view of the state’s toleration of hate speech may seem surprising given his radical rejection of liberalism. It appears liberal because MacIntyre agrees with some classical liberal conclusions, as formulated by Locke, concerning the requirement of evaluative neutrality of the state. This seems to be the main reason why MacIntyre argues that the hate speech toleration at the governmental level should not be ‘content-based’, i.e. it should be strictly ‘context-based’. The paper argues that MacIntyre’s ‘context-based’ approach seems problematic because it does not take the relevance of different political contexts seriously enough and should be modified towards the ‘regime-based’ model, in which hate speech bans are justified only by the insufficient quality of a given democratic society.
