Las investigaciones históricas no pueden llevarse a cabo sin archivos y documentos. Libros como este no existirían sin el trabajo cotidiano de los archiveros. Agradezco a todos los funcionarios del Arquivo Nacional do Rio de Janeiro que, contra muchísimas adversidades, hicieron lo mejor posible para que yo tuviera acceso a la documentación y pudiera realizar la investigación. En especial, destaco toda la ayuda recibida de Rosane Soares Coutinho y Rodrigo Mendes Queiroz. This article analyzes how the legal category of possession acquired specific meanings in nineteenth-century Brazil. I analyze 27 lawsuits that were filled before the Court of Appeals of Rio de Janeiro, between 1835 and 1889. In the first section, I present the case of "Fazenda Patrimônio", which narratively conducts the article. Then, I analyze the circulation of normativities in the Lusophone Atlantic and I show how ownership was the central legal category in land conflicts that reached the courts of the Brazilian Empire. Finally, I describe the legal category "agregados" and discuss how interpretations given to this institute by Brazilian jurists excluded the possibility that certain social groups had their rights over a piece of land recognized and protected.

Shared Atlantic legal culture: the case of a freedom suit in Benguela

Through an examination of arguments used in an 1866 freedom suit initiated in Benguela, this article highlights the existence of a shared legal culture in the Lusophone Atlantic. Through in-depth analysis of this case, I show how common institutions of the ius commune acquired specific meanings in the pro-slavery jurisdictions of Benguela and Brazil. I specifically focus on how legal categories of property law shaped the judicial language of freedom in the Lusophone Atlantic. While drawing on other nineteenth-century freedom suits, legal doctrines, and secondary literature, this analysis of a Benguela suit sheds light upon the existence of a shared Atlantic legal culture and upon a re-signification of legal categories in colonial contexts.
