Care realities are characterised by important differences between men and women. At the end of the 1990s, women were overrepresented among the oldest sections of the French population, as well as among their unpaid and paid helpers. Nevertheless, when the current national benefit scheme for elderly people needing long-term care (the APA (Allocation Personnalisée d'Autonomie)) was adopted in France, it was not explicitly framed with gender issues in mind. French subnational governments (the départements) were charged with implementing the new scheme, but also have the capacity to transform it. How has this policy been applied on the ground and with which gender-related effects? In order to answer this question, this article draws on 33 interviews and several observations conducted with street-level bureaucrats in charge of implementing the APA in a French département. Through streetlevel organisation analysis, frame analysis and discursive institutionalism, it analyses how subnational governments and street-level bureaucrats use their room for manoeuvre in policy implementation, and the frames they use to take decisions. Special attention is given to the implications of these frames from a gender perspective. This article explores three different dimensions of this issue: (1) the discursive frames attached to the APA at national and subnational organisational levels; (2) the way street-level bureaucrats perceive institutional constraints and resources, and interpret their work, and how the gender implications of these frames influence the decisions they make in practice; and (3) the consequences of administrative decisions for the public affected by them.

Resume Dans un contexte de réformes profondes du Code du travail, cette note critique propose une réflexion sur l’articulation entre deux domaines de la sociologie portant respectivement sur le travail et sur le droit. Une revue de la littérature permet de montrer que leurs croisements sont contemporains de la naissance de la sociologie d’une part, et du droit du travail d’autre part, puis de souligner les circulations et les renouvellements récents, entre France et États-Unis, auxquels a donné lieu la question de la part du droit dans l’analyse du travail. Prendre en compte le droit pour étudier le travail et ses transformations apparait aujourd’hui indispensable, tant ces deux institutions se constituent mutuellement. C’est ce que les travaux empiriques ou plus théoriques abordés dans cette note établissent, mettant en évidence l’importance contemporaine des acteurs et des usages sociaux du droit, aussi bien du travail que dans le travail.

The scalpel, the calculator and the judge in France: from technical perspective to legal evidence

In France, judicial expertise operates within a specific institutional framework at the same time as it covers a distinctive community of practitioners called upon for their technical or scientific knowledge to serve justice. Indeed, while experts in the US are selected by the litigants, the French model features judge-appointed experts. This model could offer better guarantee of independence and neutrality, to the point that recent developments in the US suggest the emergence of a new court-appointed expert. What does such an institutional model involve in terms of evidence production? To answer this question, this paper looks at two areas of expertise in France: economic experts and forensic pathologists. Through an ethnography of the co-production of legal evidence, it analyses the black box of the French practices of legal expertise and allows the way in which the institutional context influences the producing of legal evidence, beyond differences between a scalpel and a calculator, to be understood.
