Fragile Liberty: The Enslavement of Free People in the Borderlands of Brazil and Uruguay, 1846-1866

As the Atlantic slave trade came to an end in Brazil in the 1850s, a new form of trafficking began across the borders of Brazil and its neighboring countries. Free persons—mainly women and children living in small communities in Uruguay and Argentina—were kidnapped to be sold as slaves in Brazil. By analyzing the illegal enslavement of the African Rufina and her family along the border between Brazil and Uruguay in 1854, this study argues that Brazilian catchers opened up a new frontier of enslavement, kidnapping free persons in countries where slavery was already abolished. The kidnappings and the diplomatic problems that they generated brought tensions to the development of international relations between Brazil, Uruguay, Argentina, and Britain in the 1850s and 1860s.

Cet article examine la manière dont la mise en esclavage de personnes libres a été jugée et punie au Brésil tout au long du XIXe siècle. Reposant sur des affaires de « réduction à l’esclavage de personnes libres » jugées dans le Rio Grande do Sul, notre analyse – encore préliminaire – porte sur l’application de l’article 179 du code pénal brésilien. Nous souhaitons attirer l’attention sur le profil des victimes, le contexte dans lesquels ces cas se sont produits et sur les décisions qui furent prises. Les différentes affaires étudiées ont été divisées en trois groupes selon les circonstances de la mise en esclavage : Africains introduits illégalement après l’interdiction de la traite atlantique et leurs descendants, affranchis (libertos) dont les manumissions furent révoquées pour différentes raisons, noirs libres ou affranchis qui furent kidnappés et vendus comme esclaves.
