Marriage is a contract that justifies a man and a woman, with a marriage contract to build a happy and prosperous family. The marriage process has been regulated in Law Number 1 of 1974 that every marriage must be carried out according to religious provisions and must be recorded. But what about the marriage law for women who are divorced outside the religious court, according to Law Number 1 of 1974 and according to Islamic Law? Because in practice, there are also marriages that are carried out without recording so that they do not have a marriage certificate. Similarly, the occurrence of divorces that are not carried out in front of the Religious Courts, so they do not have a divorce certificate or certificate. For women who are divorced without having a divorce certificate who will enter into a new marriage. So, to legalize the marriage, one must apply for a marriage isbath for divorce.

This study has been motivated by the phenomenon of married life facing various challenges of the times. Therefore, this study has taken the topic of the importance of morals in married life, especially in realizing a harmonious and lasting family life. By focusing on Dayak Tamambaloh in Santo Martinus Parish, Sintang Diocese. This study aims to explore the values of marriage customs in light of the moral teachings of the Catholic Church. Dayak Tamambaloh views marriage as a lifelong union of a man and a woman that lasts a lifetime. This Tamambaloh Dayak marriage custom is manifested in the prohibition of adultery, the ideal form of marriage that is heterosexual and has children, and the ban on divorce. The marriage custom of the Dayak Tamambaloh is in line with the nature of marriage in the Catholic Church, which is monogamous and indivisible. This phenomenon has shown the Tamambaloh Dayak as an ethnic group that can adapt their lives to the morality and spirituality of the Catholic Church. Likewise, the Catholic Church has demonstrated a high appreciation for the noble values of the Tamambaloh Dayak culture.

Perkawinan merupakan hukum yang paling awal dikenal oleh manusia yang ditandai dengan adanya perkawinan antara Adam A.S. dengan Hawa yang kemudian dalam perkembangannya, perkawinan banyak mengalami perubahan disesuaikan dengan perkembangan masyarakat itu sendiri namun tidak menghilangkan atau mengubah syarat serta rukun perkawinan itu sendiri sebagaimana diatur dalam UU No. 1 Tahun 1974 tentang Perkawinan sebagaimana telah diubah dengan Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Adanya UU No. 16 Tahun 2019 tentang Perubahan Atas UU No. 1 Tahun 1974 tentang Perkawinan tidak mengubah keseluruhan pasal dalam UU No. 1 Tahun 1974 namun hanya mengubah pasal tertentu yaitu mengenai batasan usia perkawinan. Pada praktiknya perkawinan yang sering terjadi dalam masyarakat termasuk di kalangan artis adalah perkawinan atau pernikahan siri yang hanya dilakukan dan diakui oleh hukum agama, di mana tujuan utama dilakukan perkawinan siri adalah untuk menghindari terjadinya zina. Namun akhir-akhir ini perkawinan siri yang telah dilakukan oleh pasangan artis Rizky Billar dengan Lesti Kejora (Leslar) menjadi perbincangan hangat dan bahkan dilaporkan oleh Kongres Pemuda di Jawa Timur karena dianggap sebagai kebohongan publik sehingga diancam pidana karena tidak dipublikasikan serta dianggap sebagai bentuk pelanggaran HAM. Oleh karena itu, penulisan ini bertujuan untuk menganalisis, apakah perkawinan siri yang tidak dipublikasikan dapat dipidana, melanggar HAM dan sah atau tidak adanya pengulangan akad perkawinan yang dilakukan oleh Rizky Billar dengan Lesti Kejora.
