The economic crisis and resulting restructurings, downsizings, financial worries and fears of dismissal due to absence from work are significantly influencing employees’ decisions on whether to continue working despite ill health. Studies suggest that the economic costs of presenteeism (working while sick) far outweigh the costs of absence from work on the grounds of sickness. The level of sick pay regulation as well as weak protection against dismissal and a lack of privacy of health data are important drivers for the increase in presenteeism. Activation policies focusing on the sick or long-term sick may give rise to some significant risks for basic human labour rights such as the right to work, just and favourable working conditions, and the fundamental right to social security including paid sick leave and the right to privacy. As a result, a human-rights based approach to human resource management is needed. This is not just in the interest of employees, but is also the better option from a public health perspective.

ZAMORA Die Frage ,,lasst sich Kapitalismus immanent kritisieren?", die diesem Beitrag den Titel gibt, konnte den Eindruck erwecken, dass sie den Gegenstand der Kritik als gegeben voraussetzt und dass es nur damm geht, sich darUber Klarheit zu verschaffen, oh er sich immanent kntisieren lasst, Erst die begriffliche Bestimmung dessen, was Kapitalismus set, erlaubt eine Antwort auf die Frage, ob und welche Kritik moglich 1st. Dass ,,der" Kapitalismus als System sich nicht empirisch erkennen lasst, steht aufier Frage sowohl ftir diejenigen, die daraus die Unmoglichkeit einer Theorie des Kapitalismus ableiten, als auch fur die, die diese noch fur moglich halten. Unter letzteren, wie bekannt, scheiden sich die Geister, wenn es darum geht, die Gnmdsatze einer (kritischen) Theorie kapitalistischer Gesellschaftsformation zu bestimmen, wenn es also um die alte ,,Systemfrage" geht (Dorre et all, 2009: 14). Die Vielfalt theoretischer AnsMze kann hier nicht einmal skizzenhaft pr^sentiert werden, obwohl sie in der gegenseitigen Auseinandersetzung um Kritik eigene Konturea und vielleicht auch Argumentationskraft gewinnt (JaeggiAVesche 2009). Auch nicht thematisiert werden kann, wie eine politische Vorentscheidung fur oder gegen die Notwendigkeit einer Systemuberwmdung auf die Theoriebildung zuruckschl^gt. Hier sollen die theoretischen Potentiale von Adomos Ansatz einer immanenten Kritik des Kapitalismus im Kontext der neuen Diskussionen urn ICapitalismuskritik analysiert werden.
