What allows unpopular judiciaries to gain the trust of the public? Some suggest that judicial confidence depends on procedural integrity. Others emphasize the importance of ideological congruence between the court and the public. This article examines the explanatory power of these two leading hypotheses while also paying closer attention to the moderating effects of political and economic inclusion. It finds that confidence in the judiciary is driven by normative considerations when inclusion is high, but by ideological proximity when inclusion is low. The findings highlight that institutional support does not emerge from a single causal path. Instead, inequalities in the economic and political structure make people trust institutions for different—and sometimes contrasting—reasons.

Beginning in the 1980s, social and political actors across Latin America turned to courts in unprecedented numbers to contest economic policies. Very different patterns of high court-elected branch interaction over economic governance emerged across the region, with crucial implications for economic development, democratic governance, and the rule of law. Building on both institutional and strategic accounts of judicial politics, this article argues that high court "character," a relatively stable congeries of informal institutional features, channels interbranch struggles into persistent patterns. Two case studies illustrate the argument. In Argentina, the high court's political character encouraged a pattern of court submission to elected leaders marked by periodic bouts of interbranch confrontation over economic governance. In Brazil, the high court's statesmanlike character induced interbranch accommodation. This study demonstrates that even in politically unstable settings, institutional features can shape law and politics.

O trabalho tem como tema a judicialização da competição eleitoral municipal do Brasil, com foco nas eleições suplementares convocadas para substituir 433 eleições municipais ocorridas no período de 2004 a 2016, que foram invalidadas. A hipótese principal é que a edição da Lei Complementar n. 35, de 04 de junho de 2010, que ficou conhecida como Lei da Ficha Limpa constituiu importante fator para o aumento da judicialização da competição eleitoral e resultou em maior número de indeferimentos de registros de candidatura e cassações de diplomas de eleitos, com a consequente realização de novas eleições. Os resultados apontam que 48% das novas eleições ocorridas após a edição da Lei da Ficha Limpa, foram motivadas unicamente por este dispositivo legal. Espera-se apresentar um paradigma empírico para a pesquisa jurídica do fenômeno da judicialização da contenda eleitoral municipal, que constitui uma nova linha de atuação do judiciário nacional e cujo impacto é inegável diante do papel que os municípios ocupam na realidade brasileira.
