O objetivo deste artigo é apresentar uma reconstrução analítica da teoria da interpretação articulada por Joseph Raz em diversos dos seus trabalhos. A partir da distinção entre raciocínio sobre o direito e raciocínio a partir do direito, o trabalho articula o papel da interpretação no direito, e as razões que levam os juristas a interpretá-lo. A partir disso, desenvolve a ideia de que a autoridade, chave para a explicação positivista da natureza do direito, também explica, para Raz, a razão pela qual a interpretação desempenha um papel central na prática jurídica. Em seguida, o trabalho explica a ideia de interpretação inovadora, distinguindo-a de interpretações conservadoras, e mostra como ela permite explicar como os juízes modificam o direito – uma necessidade conceitual derivada da tese das fontes – sem que, para isso, exerçam poderes legislativos puros. Ao final, o trabalho expõe como a autoridade do direito desempenha um papel central na interpretação jurídica, mesmo quando ela abre espaço para outras considerações que conduzem à modificação do direito.
