LGBTQIA people, all around the world, experience violence, discrimination, and rights violations almost daily. In the field of human rights and healthcare more specifically, trans people have unique health risks and they face further rights violations, public shaming, and institutional violence when trying to navigate through an essentially cisgender healthcare system. On that account, this research aims to explore transgender persons’ right to access health care (or lack thereof) in South Africa and possible remedies in the African human rights system. The methodology employed consists of a brief review of literature, a qualitative design based on multiple sources, and theoretical reasoning embedded in the larger framework of human rights, more specifically a human rights-based approach to health care. The goal is to employ a somewhat innovative human rights-based approach to health care access and to analyse which international responsibilities the Republic of South Africa has regarding the health rights of transgender persons. Both the advantages and limits of international adjudication and advocacy on behalf of trans people in the African system are also discussed.

O presente trabalho trata do combate ao racismo e à discriminação racial pelo sistema interamericano de proteção aos direitos humanos. Nesse contexto, são abordadas questões referentes ao art. 4, X, da Convenção Interamericana contra o Racismo, a Discriminação Racial e Formas Correlatas de Intolerância. Verifica-se, ainda, se a incorporação do texto convencional no Brasil irá efetivar um aumento na proteção das populações não-brancas em situação de desamparo. Esse estudo, assim, contribui com a agenda de pesquisa no compromisso da erradicação de práticas discriminatórias pelo Estado brasileiro. Outrossim, tem o objetivo de fomentar a igualdade jurídica pela aplicação do artigo mencionado. Foram utilizados, para tanto, a revisão bibliográfica sobre direitos humanos e racialidade e a análise jurisprudencial, bem como o estudo de casos. Conclui-se, pois, que a incorporação da referida Convenção, se interpretada a partir de pressupostos teóricos raciais legítimos, em especial no que se refere à produção de ferramentas pedagógicas antirracistas, trará um importante fortalecimento no combate ao racismo no país, o que demanda um esforço, inclusive, dos agentes encarregados pela aplicação do texto do tratado.

RESUMOInicialmente, o trabalho apresenta um histórico da formação do sistema regional interamericano de proteção aos direitos humanos, destacando a criação da Comissão Interamericana de Direitos Humanos. A partir da análise de uma sucessão de julgados da Comissão Interamericana de Direitos Humanos, o paper avalia, em primeiro lugar, o modo como o órgão interpreta as condições de admissibilidade das demandas que noticiam violações a direitos indígenas, sobretudo os relacionados com o reconhecimento das terras tradicionalmente ocupadas por esses povos. Em seguida, com base no referencial teórico anterior e diante do fato concreto das dezenas de casos submetidos à Corte, o trabalho faz uma análise qualitativa do modo como os requisitos de admissibilidade têm sido interpretados pelo órgão do sistema regional. Como conclusão, pode-se apontar para uma certa flexibilidade da mencionada Comissão para a admissão dessas demandas, o que sinaliza para uma receptividade para o conhecimento de demandas relacionadas com terras indígenas. Para fins metodológicos, a análise se limitou aos casos submetidos à Comissão no período que se inicia com a instituição da Relatoria de Povos Indígenas (1990), destinada à especialização na abordagem dessas matérias.Palavras-Chave: Direitos Humanos.
