The protection of personal data in the cyberspace has been an issue of concern for quite some time. However, with the revolutions in information technology, big data and the internet of things, data privacy protection has become paramount in an era of free information flows. Considering this context, this research intends to shine a light on the experience of Brazil regarding data privacy protection, through the analysis of a brand new bill passed by Congress: the Brazilian General Personal Data Protection Act. Our assessment of the legislation was made from the perspective of a human rights-based approach to data, aiming to analyze both advancements, limitations and contradictions of the rights-discourse in the LGPD. Our main conclusions were that the (public and national) security rhetoric, also present in the bill, can create a state of exception regarding the processing of personal data of those considered “enemies of the state”, which may result in violations of fundamental rights and procedural guarantees.
A construção histórica e falaciosa do Canadá em torno do mito da “Terra Prometida” leva não só a um entendimento equivocado da maneira como o Governo canadense gerencia suas políticas migratórias, mas obscurece uma outra face não tão solidária dessas políticas e o consequente impacto que elas causam na vida dos migrantes, principalmente daqueles indocumentados. Portanto, este trabalho objetiva descrever, em linhas gerais, as características da imigração no Canadá e os aspectos que envolvem os processos de securitização da migração não-autorizada no país. O método de pesquisa utilizado fora o descritivo-analítico, com auxílio da revisão da literatura temática. O marco teórico utilizado para analisar o conceito de securitização partiu da Escola de Copenhague, e no contexto da securitização e criminalização das migrações irregulares lançamos mão dos postulados de Marinucci (2015), Gerard (2014), Bourbeau (2011) e Watson (2009). As principais conclusões foram que o Canadá - durante boa parte de sua trajetória histórica enquanto Estado - adotou políticas migratórias altamente seletivas: a imigração foi e continua sendo um meio para atingir os objetivos socioeconômicos do Estado canadense. Em adição, foi possível perceber que, após o estopim securitizador no pós-11 de setembro, diversos movimentos securitizadores ganharam espaço no jogo político canadense.
LGBTQIA people, all around the world, experience violence, discrimination, and rights violations almost daily. In the field of human rights and healthcare more specifically, trans people have unique health risks and they face further rights violations, public shaming, and institutional violence when trying to navigate through an essentially cisgender healthcare system. On that account, this research aims to explore transgender persons’ right to access health care (or lack thereof) in South Africa and possible remedies in the African human rights system. The methodology employed consists of a brief review of literature, a qualitative design based on multiple sources, and theoretical reasoning embedded in the larger framework of human rights, more specifically a human rights-based approach to health care. The goal is to employ a somewhat innovative human rights-based approach to health care access and to analyse which international responsibilities the Republic of South Africa has regarding the health rights of transgender persons. Both the advantages and limits of international adjudication and advocacy on behalf of trans people in the African system are also discussed.
O aumento dos fluxos imigratórios decorrentes principalmente dos diversos processos de globalização, atrelado ao envelhecimento relativo das sociedades ao redor do mundo tem trazido algumas preocupações acerca da implementação de políticas públicas para a proteção dos direitos sociais fundamentais da pessoa idosa imigrante em realidades nacionais distintas. É nesse contexto que esta pesquisa se assenta, tendo como objetivos identificar os principais avanços e desafios na implementação destas políticas públicas que visam a proteção da dignidade humana da pessoa idosa imigrante no contexto do Estado brasileiro. O método utilizado foi o descritivo-explicativo por meio de pesquisa bibliográfica e documental. As principais conclusões foram de que o principal desafio à proteção integral dos direitos fundamentais da população idosa imigrante no Brasil dar-se-á pela inexistência de marco legislativo específico e pela negligência da nova Lei de imigração em reconhecer a situação vulnerável dos idosos imigrantes no país.
