Resumo O objetivo do presente trabalho é identificar qual o tratamento jurídico atualmente dispensado no Município de Porto Alegre aos condomínios fechados e as perspectivas de nova regulamentação em curso. Além disso, busca-se propor sugestões de regulamentação dos condomínios fechados, que permitam a convergência entre o exercício do direito de propriedade e os interesses transindividuais de natureza ambiental e urbanística. A pesquisa apresenta metodologia exploratória, em especial, do marco legal atualmente existente, e da situação de fato consolidada, e uma metodologia explicativa, demonstrando um ensaio de solução conciliadora. Como método, tem-se a análise dos referenciais teóricos dos condomínios fechados, pesquisa legislativa e coleta de informações junto às serventias dos registros de imóveis de Porto Alegre. O artigo aborda, sucessivamente, os marcos legais dos condomínios fechados; as vantagens e desvantagens do acolhimento destes; a absorção do fato dos condomínios fechados diante do vácuo legal; as propostas de regulamentação da matéria no plano nacional; o tratamento conferido em Porto Alegre à matéria e os projetos em tramitação na Câmara Municipal. Por fim, a título de conclusão, propõe-se uma solução convergente entre o exercício da propriedade e a proteção dos interesses transindividuais, que porventura possam ser lesados pela disseminação dos condomínios ou loteamentos fechados.Palavras-Chave: Direito Civil. Condomínio fechado Abstract The objective of this work is to identify the legal framework currently adopted by the Municipality of Porto Alegre to gated communities and the prospects of new regulation in progress. In addition, it suggests new regulations to gated communities, which allow the convergence between the exercise of property rights and transindividual interests of an environmental and urban nature. The research presents an exploratory methodology, in particular, the current legal framework, and the consolidated situation, and an explanatory methodology, demonstrating a conciliatory solution test. As a method, the paper analyzes the theoretical references of gated communities, legislative research and information collected within the services of the real estate registries of Porto Alegre. The article deals, in turn, with the legal frameworks of closed condominiums; the advantages and disadvantages of these communities; the absorption of the fact of gated communities in the legal vacuum; the proposals to regulate the matter at national level; the treatment adopted in Porto Alegre on the matter and the projects underway in the city council. Finally, as a conclusion, we propose a convergent solution between the exercise of ownership and the protection of transindividual interests, which may be harmed by the spread of gated communities.
RESUMOInicialmente, o trabalho apresenta um histórico da formação do sistema regional interamericano de proteção aos direitos humanos, destacando a criação da Comissão Interamericana de Direitos Humanos. A partir da análise de uma sucessão de julgados da Comissão Interamericana de Direitos Humanos, o paper avalia, em primeiro lugar, o modo como o órgão interpreta as condições de admissibilidade das demandas que noticiam violações a direitos indígenas, sobretudo os relacionados com o reconhecimento das terras tradicionalmente ocupadas por esses povos. Em seguida, com base no referencial teórico anterior e diante do fato concreto das dezenas de casos submetidos à Corte, o trabalho faz uma análise qualitativa do modo como os requisitos de admissibilidade têm sido interpretados pelo órgão do sistema regional. Como conclusão, pode-se apontar para uma certa flexibilidade da mencionada Comissão para a admissão dessas demandas, o que sinaliza para uma receptividade para o conhecimento de demandas relacionadas com terras indígenas. Para fins metodológicos, a análise se limitou aos casos submetidos à Comissão no período que se inicia com a instituição da Relatoria de Povos Indígenas (1990), destinada à especialização na abordagem dessas matérias.Palavras-Chave: Direitos Humanos. Objectives: Mastectomy (Mt) is considered standard treatment for isolated local recurrence (LR) of breast carcinoma. The aim of our study was to evaluate a second conservative treatment (defined as lumpectomy followed by interstitial brachytherapy (LpIB)) and to determine if it compares favorably with the current standard treatment. Materials and methods: Between January 1981 and December 2009, 348 patients were treated to the Paoli Calmettes Institute (IPC) for an isolated LR: 232 (66,7 %) underwent Mt, 62 (17,8 %) received a second radio-surgical conservative treatment (LpIB) and 54 (15,5 %) a 2nd single surgical treatment (Lp). We classified each population according to the well known prognosis factors. Then, populations Mt and LpIB were matched taking into account these criteria to compare the overall survival (OS), metastasis free survival (MFS) and 2nd local recurrence free survival according to the treatment delivered. Results: On 348 reviewed patients, with a median follow-up of 73,3 months, 65 patients died (42/232 Mt, 8/62 TecCur, 15/54 Tec) and 100 presented metastasis (64/232 Mt, 15/62 TecCur, 21/54 Tec). There was no difference in MFS for the 2 groups, LpIB and Mt (80 % at 5 years) and the OS was non significantly better in the group LpIB compared to the group Mt (90 % and 82 % at 5 years respectively, p=0,28), whereas in the LpIB group 17% and 30% presented a relapse at 5 years and 10 years respectively. They subsequently underwent a salvage mastectomy. Worse results were obtained with lumpectomy alone (OS = 72 % and MFS = 68 % at 5 years) compared with 2 other option treatments. Conclusion: A second conservative treatment for breast cancer recurrence, i.e. lumpectomy and interstitial brachytherapy, is possible for selected patients, without any negative impact on overall survival, nor metastasis free survival.
