У кожній державі законодавчо визначені певні особливості щодо набуття громадянства. В Україні визначено принцип єдиного громадянства, що призводить до деяких складнощів, пов’язаних із подвійним (множинним) громадянством. Проблема біпатризму в Україні має комплексний характер. Після окупації Російською Федерацією української території АР Крим та початку бойових дій на Донбасі – біпатризм можна розглядати у комплексі загроз, пов’язаних із порушенням територіальної цілісності України та втратою незалежності. Аналіз чинної нормативно-правової бази свідчить про наявність певних протиріч у законодавстві стосовно питань подвійного (множинного) громадянства в Україні. Зокрема, відсутні: чітке визначення біпатризму; механізми попередження виникнення статусу біпатрида; порядок притягнення до відповідальності особи за неподання заяви про припинення громадянства України у разі добровільного набуття громадянства іншої держави. Розглядаючи іноземний досвід недопущення явища біпатризму та множинного громадянства, враховуючи недосконалість та прогалини сучасного українського законодавства можна виокремити загальні заходи внутрішньої та зовнішньої політики щодо розв’язання цієї проблеми. Зокрема, внести зміни до законодавства стосовно механізму дій представників правоохоронних органів України, а саме в частині: основ, які визначають громадянство України; визначення порядку застосування процедури припинення громадянства України; роботи МЗС України щодо продовження практики укладання міжнародних угод для виключення, у майбутньому, розбіжностей між законодавством України та законодавством іноземних держав у сфері громадянства; впровадження механізмів виявлення та запобігання випадків подвійного (множинного) громадянства. Перспективами подальших розвідок можна визначити дослідження нормативно-правових механізмів, які регулюватимуть питання множинного громадянства у міждержавних угодах щодо взаємного визнання прав громадян на множинне громадянство, а також вивчення проблеми запобігання біпатризму серед державних службовців.
The relevance of the study is due to the need to study the methods of hybrid warfare used by the Russian aggressor against Ukraine. In the spring of 2014, illegal anti-Ukrainian protest actions were organized by Russian special services in the border regions of Donbas, which were supported by local collaborators. Forced seizure of administrative buildings of local authorities continued. Pro-Russian groups of the Ukrainian local population prevented the anti-terrorist operation in every possible way, in particular, they blocked units of the Armed Forces and obstructed the work of law enforcement agencies. In the captured territories, local collaborators managed, with the assistance of Russian curators, to hold an illegal so-called “referendum” on secession from Ukraine, which was a political method of legalizing actions aimed at destroying Ukrainian statehood in certain areas of Donbas. All of the above took place in conditions of complete loss of control over the socio-political situation in the border areas on the part of local authorities, law enforcement agencies, and the complication of the involvement of Ukrainian military formations in the actions. Ukrainian historical experience has confirmed the general world practice of armed conflicts, during which the transformation of social confrontation into an open armed conflict occurs under the influence of certain socio-political conditions. The only difference is that these conditions have their own specific characteristics for each armed conflict. At the same time, relations with the Russian Federation continued to worsen in the sphere of ensuring the appropriate level of border security on the common section of the state border. Despite Ukraine’s efforts to stabilize the situation politically, the Russian Federation did not take appropriate measures and continued to act as a destabilizing factor in the border regions of the Ukrainian Donbas.
У статті представлена спроба проаналізувати трансформації, яких зазнала національна система охорони державного кордону, що відбувалися під впливом бойових умов Антитерористичної операції на сході України у продовж 2014–2018 років. Події, які розгорнулися внаслідок різкого ускладнення суспільно-політичної обстановки на українському Донбасі, продемонстрували обмеженість системи охорони державного кордону в контексті протидії військовій загрозі. Згодом це призвело до тимчасової втрати Україною контролю над окремими районами Донецької та Луганської областей. У квітні 2014 року згідно з рішенням Ради національної безпеки і оборони України Державна прикордонна служба разом із іншими відомствами сектору безпеки і оборони розпочала Антитерористичну операцію в Донецькій та Луганській областях. Мета операції – подолання терористичної загрози та збереження територіальної цілісності України. Стрімкий розвиток бойових дій вимагав від державного керівництва швидкої адаптації всієї системи охорони державного кордону до нових вимог військової обстановки. Такі умови призвели до ряду трансформацій, які охопили всі сфери прикордонної охорони. Отже, основними внутрішніми трансформаціями, яким підділася національна система охорони державного кордону, є структурні та функціональні. Виходячи із проведеного дослідження, можна вважати, що саме вони сприяли, в майбутньому, зміні моделі застосування сил та засобів прикордонного відомства України протягом 2014– 2018 років. Головна мета структурних та функціональних трансформацій полягала в тому, що всі сили сектору безпеки і оборони та органів державної влади мали бути направлені на досягнення ефективного балансу між військовими та невійськовими формами і способами ведення боротьби за територіальну цілісність України.
The study aim to purpose of the research is to develop a historical periodization of the participation of the State Border Guard Service of Ukraine in countering Russian aggression in 2014 – at the beginning of 2018. Research methodology relies on a complex of methods: his- torical and systemic; problem-chronological; historical and comparative. When establishing his- torical periodization, appropriate temporal terminology related to the category «historical time» and tested in modern historical science was used. Th e scientifi c novelty consists in the fi rst comprehensive study of historical periodization in Ukrainian historiography, which combines the main stages of the participation of border units in countering russian aggression in 2014 – early 2018. According to the authors, the proposed historical periodization is able to form an appropriate scientifi c basis for further military historical research aimed at revealing the place and role of the border department of Ukraine in countering Russian aggression in the period 2014-2018. Conclusions. Th e participation of bodies (subdivisions) of the State Border Guard Service of Ukraine in countering Russian aggression within the chronological limits of 2014 – the beginning of 2018 is expedient to divide into three historical periods, which diff er in the purpose, nature, and content of the operational-service and service-combat activities of the border units, and as well as military and political consequences for Ukraine. Th e specifi ed historical periods provide an opportunity to demonstrate the border agency’s ability to perform various tasks of a law enforcement and military nature, quickly reacting to changes in the situation in the area of responsibility, which brought positive results in the protection of the Ukrainian-Russian section of the state border of Ukraine and strengthening of national security.
