Проблематика, яка розглядається у статті, відповідає таким європейським стандартам кримінального судочинства, як забезпечення права на ефективне досудове розслідування та права на справедливий суд. У статті визначені окремі проблемні ситуації належного врегулювання в КПК видів способів збирання доказів стороною обвинувачення та моменту, з якого їх можна проводити на стадії досудового розслідування, в частині чіткості й узгодженості положень КПК та єдності практики їх застосування; наведені позиції Верховного Суду стосовно правильного застосування норм КПК; сформульовані пропозиції щодо вдосконалення положень КПК. Зокрема, звернена увага на таке. Момент, з якого сторона обвинувачення має повноваження збирати докази на стадії досудового розслідування в КПК, врегульовано не досить чітко та послідовно. Згідно з п. 5 ч. 1 ст. 3 КПК, ч. 2 ст. 214 КПК, досудове розслідування починається з моменту внесення відомостей про кримінальне правопорушення до Єдиного реєстру досудових розслідувань. Проте системний аналіз положень КПК (ч. 1 та ч. 3 ст. 214, ч. 3 ст. 208, ст. 300, ст. 520 та ін.) та практики Верховного Суду дозволяє дійти висновку, що збирання доказів стороною обвинувачення має місце вже до внесення відповідних відомостей до Єдиного реєстру досудових розслідувань (у випадку, передбаченому п. 1 ч. 1 ст. 615 КПК – до складання відповідної постанови). З метою забезпечення юридичної визначеності в частині узгодженості положень КПК, які закріплюють початок збирання доказів, видається доцільним внести зміни до редакції положень п. 5 ч. 1 ст. 3 КПК, ч. 2 ст. 214 КПК, зазначивши: «Стадія досудового розслідування починається з моменту отримання слідчим, дізнавачем або прокурором у законному порядку та із законних джерел інформації про наявність ознак вчиненого або такого, яке готується, кримінального правопорушення, або іншого суспільно небезпечного діяння». У ч. 3 ст. 214 КПК вказані не всі процесуальні дії, можливість проведення яких передбачена в інших статтях КПК до внесення відомостей до Єдиного реєстру досудових розслідувань. У рішеннях Верховного Суду звертається увага, що заборона, передбачена ч. 3 ст. 214 КПК, поширюється на проведення слідчих (розшукових) дій та негласних слідчих (розшукових) дій як основних способів збирання доказів. З огляду на вказане висловлено пропозицію внести зміни до редакції положень ч. 3 ст. 214 КПК, зазначивши: «До внесення відомостей до Єдиного реєстру досудових розслідувань не допускається проведення слідчих (розшукових) дій, крім випадків, передбачених законом».

The military aggression of the Russian Federation radically changed the life of every Ukrainian, the main priorities of politicians, and the court trial procedures. But even though the whole country rallied against a common enemy, corruption crimes have not disappeared and continue to be committed. With the introduction of martial law, the criminal procedural legislation and the procedure for investigating corruption crimes have changed. Therefore, it is important to analyze the innovations of corruption legislation, single out the most common crimes, and investigate the peculiarities of the procedure for investigating corruption crimes under martial law. The purpose of the work is the analysis of corruption crimes and the peculiarities of the investigation procedure of corruption crimes under martial law. The research methodology consists of the following methods: dialectical, systemic, historical-legal, comparative-legal, and formal-logical (analysis and synthesis, induction and deduction, proof and refutation, comparison, generalization). During the study of corruption crimes and their investigation in the conditions of military aggression of the Russian Federation against Ukraine, innovations in anti-corruption legislation and changes in criminal procedural legislation were analyzed. In particular, the peculiarities of carrying out individual investigative actions during the pre-trial investigation were researched. As a result, it was concluded that these actions are necessary and timely to protect the rights of individuals and the effectiveness of criminal procedural legislation.
The legal composition of the court is part of the concept of «right to a fair trial». Requirements for the legal composition of the court relate to the number of judges, and in some cases also compliance with additional (special) requirements for judges (proceedings against minors; proceedings containing information constituting a state secret; proceedings in the High Anti-Corruption Court). Violation of the requirements of the criminal procedure law regarding the consideration of criminal proceedings in the court of first instance by the legal composition of the court entails the revocation of the court decision. This study pays attention to the presence of some gaps and inconsistencies in the regulation of certain issues related to determining the composition of the court in the court of first instance, and suggests ways to overcome the identified shortcomings of the law. So, according to Article 512 of the CPC of Ukraine consideration of the application of coercive measures of a medical nature is carried out by a judge alone. But there are certain cases when such proceedings are carried out by a collegial court, including a jury trial. Therefore, it is proposed to amend Article 500 of the CPC of Ukraine, noting that the proceedings on the application of coercive measures of a medical nature are carried out by a court composed of a judge alone, except cases provided by the CPC of Ukraine. The CPC of Ukraine does not specify the composition of the court in considering a request for the application of coercive measures of an educational nature (for persons who committed a socially dangerous act that falls under the signs of an act under the Special Part of the Criminal Code before reaching the age of criminal responsibility). In our view, the CPC should clearly define the composition of the court in this case. Key words: court of the first instance, composition of the court, improvement of criminal procedural legislation.
