The paper substantiates the idea that while performing law enforcement functions correctional institutions face the risks of illegal behavior on the part of those individuals who do not want to embark on the path of reformation. The most effective response to the facts of criminal acts committed by convicts is associated with the implementation of the principle of the inevitability of criminal punishment for such behavior. The speed of such a response is of paramount importance and depends on corrections officers themselves. The response can be effective only if officers of the Federal Penitentiary Service of Russia (FSIN Russia) use the full range of procedural and criminalistic tools at their disposal. Based on the analysis of the criminal procedure status of institutions, bodies and officials of FSIN Russia and the content of their functional responsibilities, we make an attempt to find out whether corrections officers need criminalistic knowledge. We identify the main areas in which corrections officers demand criminalistic knowledge. These include: law enforcement (for direct use in the implementation of criminal procedure powers, as well as for indirect use in the implementation of their main activities aimed at the execution of criminal penalties), education (for training personnel for penal institutions and bodies), and research (for further elaboration on the issues related to the investigation of prison offences).
Введение: в статье комплексно рассматривается процессуальный механизм возобновления производства по уголовному делу ввиду новых или вновь открывшихся обстоятельств, предназначенный для обеспечения правосудности судебных решений. Он применим в случаях, когда после вступления в законную силу приговора, определения или постановления по некогда разрешенному уголовному делу становятся очевидными отдельные обстоятельства, которые по разным причинам не были известны суду. Причем юридическая значимость таких обстоятельств настолько высока, что позволяет заинтересованной стороне поставить под сомнение законность, обоснованность и справедливость уже вступившего в силу судебного решения. В подобных случаях приговор, определение или постановление суда могут быть отменены, а производство по уголовному делу возобновлено ввиду новых или вновь открывшихся обстоятельств, в рамках чего возможен пересмотр любых вступивших в законную силу решений всех без исключения судебных инстанций. Цель: анализ практики применения процессуального института возобновления производства по уголовному делу ввиду новых или вновь открывшихся обстоятельств и формулировка предложений по совершенствованию реализации возможностей защиты прав и законных интересов участников процесса. Методы: теоретический анализ и оценка практической реализации института возобновления производства по уголовному делу ввиду новых или вновь открывшихся обстоятельств, основанные на обобщениях судебной практики и доктринальных исследованиях российских ученых. Выводы: рассмотрев особенности данного производства, автор приходит к выводу, что основанием для возобновления производства по уголовному делу ввиду новых или вновь открывшихся обстоятельств не может служить неправосудность вынесенных по делу решений, если она явилась результатом судебной ошибки, в том числе подтвержденной выявленными уже после вступления в законную силу дополнительными доказательствами, свидетельствующими о невиновности или меньшей виновности осужденного. Главное отличие возобновления производства ввиду новых или вновь открывшихся обстоятельств состоит в неполноте осведомленности суда при ординарном рассмотрении уголовного дела по существу. Именно она, по мнению автора, предопределяет процессуальную специфику этого уголовно-процессуального производства и актуализирует постановку вопроса об оптимизации структуры УПК РФ путем выделения в нем данного процессуального механизма в ряду иных производств, нацеленных на пересмотр решений суда. Abstract Introduction: the article comprehensively examines a procedural mechanism for resuming criminal proceedings due to new or newly-revealed circumstances, specifically designed to ensure justness of judicial decisions. It is applicable in cases when, after the entry into force of a verdict, ruling or court decision on a once-resolved criminal case, certain circumstances become apparent that, for various reasons, have not been known to the court. Moreover, legal significance of these circumstances is so high that it allows the interested party to question legality, validity and fairness of a court decision that has already entered into force. In such cases a verdict, ruling or court order may be canceled, the criminal proceedings resumed due to new or newly-revealed circumstances, and any decisions of all judicial instances without exception that have entered into legal force can be reviewed. Purpose: to analyze the practice of applying the procedural institution of resuming criminal proceedings in view of new or newly-revealed circumstances and formulate proposals for improving the implementation of opportunities to protect the rights and legitimate interests of participants in the process. Methods: theoretical analysis and evaluation of the practical implementation of the institute of resumption of criminal proceedings in view of new or newly-revealed circumstances, based on generalizations of judicial practice and doctrinal studies of Russian scientists. Conclusions: having studied distinctive features of this proceeding, the author comes to the conclusion that the criminal proceedings in view of new or newly-revealed circumstances cannot be resumed in case of judicial errors, including those confirmed by additional evidence proving innocence or the lesser guilt of the convicted person revealed after the decision has become enforceable. The court’s unawareness during ordinary consideration of the criminal case is the main distinguishing feature of resuming proceedings due to new or newly-revealed circumstances. It determines the specifics of these criminal proceedings and actualizes the question of optimizing the structure of the Criminal Procedural Code of the Russian Federation, through a clear separation of this procedural mechanism from other proceedings aimed at reviewing court decisions.

На фоне рассмотрения конституционных положений, идей, нашедших отражение в Концепции судебной реформы, и некоторых исторических обобщений в ней проанализировано нынешнее состояние этого законодательного акта, а также его наиболее существенные новации. Автор характеризует их в качестве весьма полезных для следственной и судебной практики, поскольку с их появлением стали происходить позитивные изменения в содержании и формах правоприменительной деятельности. Также им отмечается положительная динамика в механизме соблюдения прав и свобод человека и гражданина в уголовном судопроизводстве, которое, с его точки зрения, по-прежнему нуждается в последовательном и целенаправленном обновлении, в поиске и безотлагательной реализации новых подходов, соответствующих самым взыскательным критериям обеспечения защиты прав и законных интересов потерпевших от преступлений, а также личности от незаконного обвинения, осуждения, ограничения ее прав и свобод. The writing of this article is timed to coincide with the twentieth anniversary of the entry into force of the Russian Criminal Procedural Code. Against the background of consideration of constitutional provisions, ideas reflected in the Judicial Reform Concept, and some historical generalizations, it analyzes the current state of this legislative act, as well as its most significant innovations. The author considers them as very useful for investigative and judicial practice, since their appearance triggered positive changes in the content and forms of law enforcement activities. He also notes positive dynamics in the mechanism of observance of human and civil rights and freedoms in criminal proceedings, which, from his point of view, still needs to be consistently and purposefully updated. It is required to search and urgently implement new approaches that meet the most demanding criteria for ensuring protection of the rights and legitimate interests of crime victims, as well as individuals from unlawful accusation, conviction, restriction of their rights and freedoms.
В статье рассматриваются актуальные вопросы, непосредственно связанные с рассмотрением уголовных дел в судебном заседании.
