Faraid merupakan sebuah sistem pengurusan harta selepas kematian yang dianjurkan oleh Islam. Di Malaysia, bidang kuasa hal ehwal Islam termasuk pengurusan harta pusaka adalah terletak di bawah kuasa pentadbiran negeri. Walau bagaimanapun, sistem pengurusan harta pusaka pada masa kini dilihat masih memerlukan kepada penambahbaikan dan transformasi dari sudut pengurusan dan pentadbirannya. Anggaran sebanyak 60 Bilion harta masih belum dituntut disebabkan oleh kesedaran masyarakat tentang pengurusan harta pusaka masih lagi di tahap yang rendah di samping kekeliruan dengan wujudnya pelbagai agensi yang menguruskan harta pusaka. Justeru, pembangunan model pusat sehenti pengurusan harta pusaka atau FOSC (Faraid One-Stop Centre) ini merupakan sebuah inisiatif yang dibangunkan untuk memudahkan masyarakat menyelesaikan masalah berkaitan harta pusaka dengan lebih efisien dan kondusif. Model pusat sehenti pengurusan harta pusaka (FOSC) ini menyatukan semua agensi-agensi yang terlibat dengan pengurusan harta pusaka di bawah satu pusat bagi memudahkan pengurusan harta pusaka. Model FOSC terdiri daripada lima agensi iaitu Faraid USIM Consultant (FUSACA), Bahagian Harta Pusaka Kecil, Amanah Raya Berhad, Majlis Agama Islam Negeri dan Agensi Guaman & Perunding. Faraid USIM Consultant (FUSACA) dijadikan agensi yang berperanan penting dalam membuat keputusan dan memberi khidmat nasihat kepada pelanggan. Manakala, Bahagian Harta Pusaka Kecil sebagai agensi yang merekod kes yang dipohon dan diselesaikan dan Amanah Raya Berhad merupakan agensi yang menguruskan hal yang melibatkan harta alih dan mengeluarkan Akuan atau Arahan bagi harta alih. Majlis Agama Islam Negeri menyediakan khidmat pengiraan jumlah nilaian dan bahagian harta pusaka dan Agensi Guaman & Perunding sekiranya pelanggan memerlukan khidmat peguam atau nasihat. Model FOSC ini boleh menjadi rujukan dan panduan kepada agensi berwajib berkaitan harta pusaka dalam mewujudkan pusat sehenti di negeri masing-masing. Model FOSC ini juga amat diyakini dapat memperkasakan pengurusan harta pusaka di Malaysia dan secara langsung dapat memudahkan masyarakat menguruskan harta pusaka secara mudah dan sahih.
Islam telah menetapkan kaedah tertentu dalam pembahagian harta warisan termasuklah tanah adat. Dalam pada itu, budaya setempat mempunyai kaedah tersendiri dalam isu pemberian tanah adat yang berbeza dengan kaedah faraid. Kajian ini akan mengkaji sejauh mana budaya setempat atau uruf ini boleh diterima pakai dalam isu pembahagian tanah adat khususnya di Negeri Sembilan. Dalam masa yang sama, kajian ini akan membincangkan syarat-syarat penerimaan uruf dalam pemberian harta pusaka berdasarkan nas al-Quran, Hadis dan pandangan ulama fikah serta dapatan temuramah. Kajian ini merupakan kajian kualitatif deskriptif yang menggunapakai kaedah analisa dokumen dan temubual berstruktur separa. Hasil kajian ini merumuskan bahawa perwarisan tanah adat adalah suatu praktis yang telah diamalkan sejak zaman berzaman di Negeri Sembilan mengikut adat Minangkabau tetapi perlu diselarikan dengan hukum syarak. Selain itu, pemberian tanah adat ini tidak bersifat mutlak, tetapi berdasarkan konsep pemegang amanah yang menyatakan bahawa wanita menjaga amanah tanah adat suku masing-masing. Kajian ini sangat signifikan dalam menyelesaikan isu pewarisan tanah adat untuk menentukan sama ada praktis pemberian tanah adat adalah bertepatan atau bersalahan dengan hukum syarak.
Family management conflict in resolving the estate becoming increasingly critical and can achieve a level of concern if not addressed properly. A case of successive deaths in faraid is part of a complex and difficult conditions for the governed because it involves the death of layered beneficiaries. A network of death in a family inheritance is part of the implications if the first deceased's estate is not postponed for solutions. In this regard, fiqh al-mirath (Islamic law of inheritance) has set the approach of al-munasakhah as a formula for those who are entitled. The approach of al-munasakhah is an important recommendation in the completion of distribution of inheritance involving cases of successive deaths. This article aims to explain the diversity of successive deaths in faraid and approach of al-munasakhah used in resolving such cases. Focus will be given to cases solution through al-Shafii sect according to the perspective that is based on the records and documentation works in selected references. This description shows the interest of al-munasakhah is as a form of calculation and settlement to a conflict case faraid distribution to the heirs. This is due to fact that more beneficiaries will increase the difficulty in solving faraid cases. In addition, this approach proved the comprehensiveness of the law of inheritance in Islam where estates need to be solved and not to be left idle and frozen without benefit. Abstrak Kemelut pengurusan keluarga dalam menyelesaikan harta pusaka semakin kritikal dan boleh mencapai tahap membimbangkan jika tidak ditangani dengan baik. Kes faraid berangkai merupakan sebahagian kondisi yang kompleks dan sukar untuk ditadbir kerana membabitkan kematian berlapis daripada kalangan waris yang berhak. Rangkaian beberapa kematian dalam sesebuah keluarga yang mempunyai hubugan pewarisan merupakan sebahagian implikasi sekiranya harta pusaka si mati yang pertama tidak ditangguhkan penyelesaiannya. Dalam hal ini, perundangan fiqh al-mirath menetapkan pendekatan al-munasakhah sebagai satu formula faraid yang lengkap untuk memberi hak kepada mereka yang berhak. Pendekatan al-munasakhah ini merupakan satu saranan penting dalam melengkapkan bentuk agihan faraid yang melibatkan kes faraid berangkai. Makalah ini bertujuan menerangkan kepelbagaian kes faraid berangkai yang berlaku disebabkan kematian individu yang mempunyai hubungan pewarisan dan pendekatan al-munasakhah yang digunakan dalam menyelesaikan kes-kes tersebut. Tumpuan akan diberikan kepada kes faraid berangkai dan bentuk penyelesaian melalui pendekatan al-munasakhah menurut perspektif mazhab Syafie iaitu berdasarkan rekod dan dokumentasi karya fiqh terpilih mazhab tersebut. Huraian ini memperlihatkan kepentingan pengiraan al-munasakhah ialah sebagai satu bentuk pengiraan dan penyelesai kepada konflik kes faraid berangkai dengan menentukan agihan yang tepat kepada waris yang masih hidup. Hal ini kerana, semakin ramai waris akan menyebabkan kesukaran semakin bertambah untuk menyelesaikan sesuatu kes harta pusaka. Selain itu, pendekatan ini memperlihat sebahagian bukti kesyumulan perundangan pusaka dalam Islam iaitu harta pusaka perlu diselesaikan agihannya hingga selesai, tidak dibiarkan beku dan terbiar tanpa dimanfaatkan.
Kemelut pengurusan harta keluarga yang melibatkan harta pusaka semakin merumitkan saban hari sehingga memberi kesan kepada kebajikan waris. Pensyariatan hukum faraid yang meletakkan matlamat akhir iaitu memberi hak kepada yang berhak seharusnya dilihat secara menyeluruh dalam menyelesaikan kemelut ini. Kaedah al-radd (pulangan semula) merupakan sebahagian hukum faraid yang menumpukan kepada strategi untuk menghabiskan lebihan pusaka dengan menyerahkan semula kepada waris si mati yang ada terutama waris ashāb al-furūd. Justeru itu, makalah ini bertujuan untuk menjelaskan kedudukan al-radd sebagai satu kaedah agihan dalam hukum faraid. Tumpuan akan diberikan kepada pandangan ilmuan faraid berkaitan kaedah ini dan bentuk pengiraannya untuk menjaga kebajikan waris. Selain daripada itu, perbincangan akan menghuraikan sejauhmana penerimaan kaedah ini untuk diterima pakai di Malaysia. Untuk mencapai tujuan tersebut, penulisan ini adalah berbentuk kualitatif iaitu berdasarkan pengumpulan data yang memfokuskan metode kepustakaan. Analisis data memfokuskan nas-nas syarak dan huraian ilmuan fiqh berkaitan kaedah al-radd. Hasil kajian mendapati terdapat perselisihan pandangan mazhab fiqh dalam agihan faraid menggunakan kaedah al-radd. Keterikatan untuk menjadikan mazhab Syafie sebagai rujukan utama di Malaysia merupakan sebahagian kekangan untuk melaksanakan kaedah ini dan seterusnya menyebabkan kebajikan waris ashāb al-furūd tidak dapat dicapai.
Zakat management is subject to the authority and views of the local government. In Malaysia, the State Islamic Religious Council (MAIN) in everu state is the ruling authorities in the management of zakat includes the collection of zakat from the local community. Base on the current survey, all MAINs have appointed certified agents or amil within the institutions, groups or individuals to facilitate the collection of zakat in their respective states. Permission to collect zakat is essentially implemented on local base and appointed agents are not allowed to collect zakat across the state borders. Generally, almost all states provide enactments, acts or ordinances explaining Shariah criminal penalties and offenses for the act of collecting zakat in other states without permission. However, there are cases and issues arose from this crime activity among amil or unauthorized agents. This action indirectly affects zakat institutions and zakat recipients negatively. The objective of this study is to identify issues and modus operandi associated with zakat collection across states by unauthorized agents and amil. The study will also assess issues related to Islamic view including the issued fatwas while suggesting alternatives as solution to this polemic. This study utilises qualitative approach involving interviews and documentation in data collection. The findings show that the issue of zakat collection in other states by unauthorized agents and amils are contradict to Syariah Administration law in Malaysia. This study hopefully can be a reference to zakat institutions, MAIN, state mufti departments and zakat-authorized bodies in Malaysia in addressing the issue of across states zakat collection. Further studies on the effects of this issue on zakat institutions and zakat recipients in the affected states need to be carried out to ensure that this wrongdoing can be curbed effectively. ABSTRAK: Pengurusan perihal zakat adalah tertakluk kepada kuasa dan pandangan pemerintah setempat. Di Malaysia, Majlis Agama Islam Negeri (MAIN) negeri-negeri adalah pemerintah yang berkuasa dalam pengurusan zakat termasuklah berkaitan kutipan zakat masyarakat setempat. Berdasarkan tinjauan semasa, semua MAIN telah melantik ejen atau amil yang bertauliah dalam kalangan institusi, kelompok atau individu bagi memudahkan lagi proses kutipan zakat di negeri masing-masing. Kebenaran mengutip zakat tersebut hakikatnya adalah bersifat lokal dan tidak dibenarkan merentasi sempadan negeri lain. Umumnya, hampir kesemua negeri memperuntukkan enakmen, akta atau ordinan yang menjelaskan hukuman dan kesalahan jenayah Syariah bagi perbuatan mengutip zakat di negeri lain atau tanpa kebenaran. Namun begitu, timbul beberapa kes dan isu yang melibatkan kesalahan mengutip zakat dalam kalangan amil atau ejen yang tidak bertauliah di negeri lain. Perkara ini secara tidak langsung memberi kesan kepada institusi zakat dan penerima zakat. Objektif kajian ini adalah untuk mengenal pasti isu berkaitan kutipan zakat di negeri lain oleh ejen dan amil yang tidak bertauliah. Kajian juga akan menilai isu-isu yang berkaitan menurut pandangan syarak termasuk fatwa yang dikeluarkan di samping mencadangkan alternatif sebagai solusi bagi polemik ini. Kajian ini menggunakan pendekatan kualitatif yang melibatkan kaedah temu bual dan dokumentasi dalam pengumpulan data. Hasil kajian mendapati bahawa isu kutipan zakat di negeri lain oleh ejen dan amil yang tidak bertauliah adalah bertentangan dengan syarak dan perundangan Syariah di Malaysia. Kajian ini boleh menjadi rujukan dan panduan oleh pihak institusi zakat, MAIN, jabatan mufti dan badan-badan berautoriti zakat di Malaysia dalam menangani isu kutipan zakat di negeri lain. Kajian lanjutan berkaitan kesan isu ini terhadap institusi zakat dan penerima zakat di negeri yang terlibat perlu dijalankan bagi memastikan gejala ini dapat ditangani sebaik mungkin.
