Indonesia menjadi negara agraris karena Indonesia memiliki hasil pertanian dan perkebunan yang melimpah. Kekayaan alam tersebut jika dikelola dan dilindungi dengan benar, dapat meningkatkan kesejahteraan bagi masyarakat lokal. Hak Kekayaan Intelektual merupakan sarana yang tepat untuk melindungi kekayaan tersebut. Kekayaan Intelektual memiliki pengertian bahwa hak yang bersifat eksklusif (khusus) yang dimiliki oleh para pencipta/ penemu sebagai hasil dari aktivitas intelektual dan kreatifitas yang bersifat khas dan baru. Ruang Lingkup Kekayaan Intelektual terdapat 8 bagian di dalamnya, salah satunya adalah indikasi geografis. Indikasi geografis adalah suatu tanda yang menunjukkan daerah asal suatu barang dan/atau produk yang karena faktor lingkungan geografis termasuk faktor alam, faktor manusia atau kombinasi dari kedua faktor tersebut memberikan reputasi, kualitas, dan karakterisitik tertentu pada barang dan/atau produk yang dihasilkan. Dengan indikasi geografis dapat melindungi dan memanfaatkan kekayaan alam untuk kesejahteraan masyarakat lokal. Karena di dalam indikasi geografis memuat hak ekonomis bagi masyarakat lokal. Hak ekonomis merupakan hak untuk mengelola dan memanfaatkan indikasi geografis yang memiliki tujuan untuk mensejahterakan masyarakat lokal.
Music and songs are one of the areas of Intellectual Property Rights which are protected in Article 58 letter (d) of UU Number 28 of 2014 about Copyright, namely Copyright Protection for Song or music creations with or without text. In this digital era, there are many ways for us to get the music we want through various platforms on the internet such as Youtube, Joox, Spotify, and others. Because the means to get music are getting easier now, there are more and more copyright violations against music, ranging from piracy to plagiarism. This study aims to discuss how the Copyright law regulates copyright protection in the field of music on the internet and also how the Spotify music service platform protects copyright. The research method used is a normative research method; the data analyzed is secondary legal data consisting of primary legal materials, namely Copyright Law and Secondary Law materials, namely literature related to research problems. Based on the results of the study, it is known that Spotify as one of the world's famous song streaming applications has the exclusive right as a copyright licensee to exercise exclusive rights as regulated in Article 9 of the Copyright Law. Spotify as a streaming service provider must of course have a license for the music or songs provided in the application through a license agreement with the licensor.
Mining, along with plantations, is one of the main economic backbones of the Indonesian provinces of Kalimantan. The main concern of extractive economics is deforestation and environmental damage that threatens natural sustainability. Most of the previous research focused on the issue of environmental sustainability in the industrial context and regional spatial planning. To fill this void, this study originally aims to analyze how local wisdom is useful in managing ex-mining reclamation practices. This research was conducted in Margahayu, Kutai Kertanegara, East Kalimantan Province. The method used in this research is empirical legal research by adopting a data-based approach. The results show that ex-mining reclamation in Margahayu aims to restore the land use according to its function and is beneficial for agriculture and small-scale plantations. The findings underline that the participation of local communities is very useful in restoring the function of the ex-mining land, due to their interest in rehabilitating spatial planning and ecological supports that are useful for their livelihoods. In this context, this finding requires inclusion of local interest-based participation as an important social infrastructure in reforestation and mine land reclamation in Kalimantan.
Penyuluh berkedudukan sebagai pelaksana program pemberdayaan petani melalui penyuluhan pertanian pada instansi pemerintah baik ditingkat pusat maupun daerah. Penyuluh pertanian memiliki fungsi sebagai agent yang memberikan informasi atau pengetahuan kepada petani agar lebih baik dalam mengelola usahatani guna meningkatkan kesejahteraan petani. Metode yang digunakan dalam penulisan ini yaitu metode penelitian normatif. Bahan hukum yang digunakan pada penelitian normatif yaitu: peraturan perundang-undangan, norma hukum, kaidah hukum, asas-asas hukum, teori-teori hukum dan doktrin hukum. Tujuan penelitian ini untuk: (1) menganalisis bgaimana Kedudukan Penyuluh Pertanian Lapangan dalam memberdayakan petani Kopi Gunung Kelir menurut Perbup No. 33 Tahun 2020; (2) menganalisis bagaimana Fungsi Penyuluh Pertanian Lapangan (PPL) dengan keberdayaan kelompok tani. Penyuluhan kepada petani berdasarkan perpektif Indikasi Geografis berdampak pada terjaganya reputasi, karakteristik hasil khas daerah pertanian. meningkatkan produktivitas, efisiensi usaha, pendapatan, dan kesejahteraannya, serta meningkatkan kesadaran dalam pelestarian fungsi lingkungan hidup. Fungsi utama PPL sebagai Agent of Change bagi pengembangan petani dalam mendampingi petani masyarakat pedesaan.
This paper aims to describe and analyze the contribution of Islamic law in the regulation (policy formulation) of the death penalty in the context of reforming the national criminal law. Determining the death penalty as a means to tackle crime is a policy choice because capital punishment is a pro and con issue among legal experts. Because the debate about the death penalty is related to the right to life which in international legal instruments and the 1945 Constitution is included in the category of rights that cannot be reduced under any circumstances (non-derogable rights). Islamic law recognizes the death penalty in a crime that has been determined by Allah SWT. in the Al-Qur’an. The death penalty in Islam gives its color with the idea of balance that does not only focus on the perpetrators of the crime but also the victim. Of course, this idea of balance is following the basic values of Pancasila. The death penalty in Islam in the qishahs punishment recognizes the concept of forgiveness from the victim’s family which needs to be developed in the future, especially in the draft Criminal Code which until now has not been ratified as a means for national law reform.
