The basic principle of the functioning of local self-government is its independence, which is limited by the applicable law created in accordance with the principle of subsidiarity. The article analyzes the normative acts concerning the participation of local self-government bodies in the law-making process. Observation of the practice of their application leads to the conclusion that these solutions are not effective, and they do not correspond to the constitutional guarantees of the territorial self-government system position. The conclusions propose a new mode of selecting the Polish Senate and Self-Government Commission as well as the Polish delegation to the EU Committee of the Regions, which could improve the influence of territorial self-government bodies and the quality of solutions adopted in legal acts.

Problem ten znajduje również odbicie w obecnym życiu politycznym, czego widocznym przykładem stało się powołanie komisji śledczych w sprawie nowelizacji ustawy o Radiofonii i Telewizji czy też w sprawie nowelizacji ustawy o grach losowych. Niniejszy artykuł jest próbą analizy zarówno pojawiających się postulatów racjonalizacji procesu stanowienia prawa, jak i utworzenia katalogu największych problemów w tym obszarze.Jednym z kluczowych dylematów związanych z tworzeniem prawa był i jest problem związany z określeniem optymalizacji trybu tworzenia prawa. Znajduje on szerokie odbicie w literaturze przedmiotu. 1Analizę należy rozpocząć jednak od stwierdzenia, że polska Konstytucja z 1997 r. w sposób wyjątkowo szczegółowy określiła system źródeł prawa, poświęcając im oddzielny rozdział III ustawy zasadniczej. Rozwiązanie takie w konstytucjonalizmie europejskim nie ma precedensu. Jest to zatem najbardziej szczegółowa regulacja, jeśli chodzi o państwa należące do Unii Europejskiej. Co więcej, poza wymienionymi wcześniej przepisami, Konstytucja RP z 1997 r. rów-nież w sposób szczegółowy określa w rozdziale IV procedurę ustawodawczą.Po blisko 20 latach od czasu uchwalenia obowiązującej obecnie ustawy zasadniczej można zatem zadać pytanie, czy spełniły się nadzieje związane z przyję-ciem omawianych rozwiązań. Wydaje się, że albo przeceniono znaczenie przyję- Jak wynika to z samego tytułu rozdziału III Konstytucji, jego przepisy określają konstytucyjny system źródeł prawa, nie są jednak w stanie optymalizować samego trybu ich wydawania. Z perspektywy czasu można powiedzieć, że twórcy Konstytucji mieli rację, umieszczając w tym rozdziale art. 90 i art. 91, bez których nasza akcesja do Unii Europejskiej byłaby znacznie utrudniona. Z tego powodu można stwierdzić, że przepisy rozdziału spełniły swoje historyczne zadanie.W pierwszych latach obowiązywania Konstytucji z 1997 r. w doktrynie pojawiło się wiele głosów krytycznych, dotyczących treści konkretnych norm tego rozdziału ustawy zasadniczej. Odnosi się to w szczególności do pojęcia "zamkniętego systemu źródeł prawa". Trudne do stosowania w praktyce okazały się też postanowienia dotyczące zakazu subdelegacji. 2Zgodnie z regulacją art. 92 ust. 1 ustawy zasadniczej rozporządzenia są wydawane przez organy wskazane w Konstytucji, na podstawie szczegółowego upoważnienia zawartego w ustawie i w celu jej wykonania. Upoważnienie powinno określać organ właściwy do wydania rozporządzenia i zakres spraw przekazanych do uregulowania oraz wytyczne dotyczące treści aktu.Wynika z tego, że podstawowym aktem określającym prawa i obowiązki podmiotów powinna być ustawa. Dotyczy to także naszych zobowiązań jako członka Unii Europejskiej. Implementacja prawa unijnego również wymaga ustawy, chociaż często są to regulacje o charakterze technicznym i mogłyby być uregulowane w aktach o charakterze podustawowym. Związki między gałęziami prawa konstytucyjnego i administracyjnego z punktu widzenia regulacji Konstytucji RP z 1997 r.Overlaps Between the Branches of Constitutional and Administrative Law from the Point of View of the Constitutional Regulations from the 1997 Constitution of the Republic of Poland Rozważania wypada rozpocząć od problemu, czy prawo konstytucyjne możemy traktować jako gałąź analogiczną do innych w systemie prawa. Powszechnie wiadomo, że gałąź prawa to w toku historycznym ukształtowany zbiór norm prawnych regulujący daną dziedzinę życia. Powinna ona charakteryzować się specyfiką regulacji i swoistością sankcji prawnej. Na gałąź prawa składa się kilka zaliczanych do niej dziedzin. W przypadku gałęzi prawa administracyjnego są nimi: prawo administracyjne ustrojowe, któ-re określa strukturę oraz zasady funkcjonowania administracji publicznej; prawo administracyjne materialne, które reguluje prawa i obowiązki organów administracji publicznej i obywateli; prawo administracyjne procesowe, które określa postępowanie administracyjne. W istocie jednak brak jest w przypadku prawa administracyjnego kodyfikacji przepisów prawa materialnego. Nie ma chociażby kodyfikacji części ogólnej tej gałęzi prawa. Na uwadze mieć trzeba także zasadniczo wertykalny charakter stosunków administracyjnoprawnych odznaczających się brakiem swobody adresata działań administracji publicznej z jednej strony i przymusem, którym dysponuje organ administracji publicznej z drugiej strony.Miejsce prawa konstytucyjnego w systemie prawa wydaje się dobrze opisywać rzymski podział na prawo prywatne i publiczne, w którym podstawowym kryterium rozróżnienia tych praw jest "korzyść" (łac. utilitas). After the accession of Poland to the European Union our country started to be defined as a decentralized state with a regional structure. The aim of this paper is to compare Polish legal solutions to the Italian and Spanish solutions regarded as classic models of regionalism. The effect of the analysis is the conclusion that the biggest obstacle for the development of regionalism in Poland is the lack of proper legal regulations including constitutional regulations. It is responsible for the fact that Polish voivodships do not have guarantees of territorial integrity. Theoretically there is even a possibility to replace them with other units of territorial division. Other restrictions for regional development are: insufficient level of financing and the lack of formed social ties in newly formed voivodships. Due to these factors voivodships do not play their own political role. The situation could be changed as a result of an enlargement of regional competences and granting voivodships limited autonomy similarly to the situation in Italy and Spain.
