<p>Penelitian ini bertujuan untuk mengkaji proses pertukaran pesan dan tanda dalam suatu komunikasi antara tersangka/terdakwa atau penasihat hukumnya dengan Penyidik dan Penuntut Umum, pada dasarnya, bukanlah merupakan proses kontaminasi biner. Dimana, Penyidik dan Penuntut Umum sebagai pemegang kekuasaan merupakan oposisi biner “<em>the central</em>” melakukan produksi pengetahuan berbasis kepada kepentingannya. Pada akhirnya, proses permintaan turunan BAP dan Berkas Perkara tersebut, lebih dinuansai oleh logika monolog dimana ketidakmampuan tersangka/terdakwa atau penasihat hukumnya untuk membantah atau menyanggah pengetahuan yang menyimpangi teks Pasal 72 KUHAP <em>jo </em>Pasal 143 ayat (4) KUHAP, yang patut diduga pula sebagai upaya langgengkan kepentingan dari pemiliki otoritas dengan tidak menyiapkan upaya hukum atas penolakan tersebut. Padahal, rangkaian teks Pasal 72 <em>jo </em> Pasal 143 ayat (4) KUHAP seharusnya dimaknai sebagaimana landasan filosofis dalam Konsideran Menimbang huruf a KUHAP sebagai suatu bentuk perlindungan atas hak yang asasi dari tersangka/terdakwa guna melakukan dan mempersiapkan pembelaan bagi dirinya dalam proses persidangan. Pembentukan logika monolog tersebut bertitik tolak dari suatu perumusan masalah yaitu Bagaimana pembentukan logika monolog dalam praktik peradilan pidana dalam kaitannya penerapan Pasal 72 KUHAP <em>jo</em> Pasal 143 ayat (4) KUHAP? Penelitian ini menggunakan metode penelitian yuridis normatif. Adapun hasil dari penelitian ini adalah adanya suatu bentuk ujaran/tindak tuturan dalam suatu proses komunikasi sebagai semiotika konotatif terhadap norma hukum Pasal 72 KUHAP <em>jo</em> Pasal 143 ayat (4) KUHAP, yang menghindari kewajiban normatif dari Penyidik dan Penuntut Umum terhadap tersangka/terdakwa.</p>
Tujuan penelitian ini adalah mengkaji Alternatif Penyelesaian Sengketa (ADR) transaksi online perdagangan internasional melalui Online Dispute Resolution (ODR). Metode yang digunakan adalah penelitian kualitatif dengan pendekatan yuridis normatif. Hasil temuan menunjukkan bahwa Alternatif Penyelesaian Sengketa (ADR) diatur oleh Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa ADR. Undang-Undang Republik Indonesia tentang Informasi dan Transaksi Elektronik sebagaimana telah direvisi dengan Undang-Undang Nomor 11 Tahun 2008, juga mengatur tentang transaksi elektronik. Badan Arbitrase Nasional Indonesia (BANI) memiliki keputusan terakhir tentang apakah teknik Arbitrase Online dapat digunakan dalam arbitrase Indonesia atau tidak. The goal of this research is to examine Alternative Dispute Resolution (ADR) for international commerce transactions conducted online through Online Dispute Resolution (ODR). The research method adopted is qualitative with a normative judicial orientation. According to the findings, Alternative Dispute Resolution (ADR) is governed by Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution. Electronic transactions are likewise regulated by the Republic of Indonesia's Law on Electronic Information and Transactions, as amended by Law No. 11 of 2008. The Indonesian National Arbitration Board has the final decision on whether or not to allow Online Arbitration in Indonesian arbitration.
Adjustment of relations between parties and places of communication is not only pegged to space and time, this happens because of the sophisticated technology and ease of communication that has developed rapidly as a result of the big changes in the Industrial Revolution Era 4.0. The activity of resolving business dispute problems during this pandemic is greatly helped by the existence of electronic arbitration whose implementation process can be carried out using various existing arbitration institutions. Writing this journal aims to explain and urge the public that resolving business disputes can use arbitration institutions and be accompanied by legal force. Using normative and empirical legal research methods is the right solution in compiling this research, and taking a legislative and comparative law approach is expected to complete this research. As long as the provisions of Law no. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution (UUAAPS) goes hand in hand, so the electronic arbitration arrangements and procedures remain in effect. The need for Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions as the legal basis for supporting the provisions of Article 4 paragraph (3) of the AAPS Law is to strengthen the regulations in Article 4 paragraph (3) of the AAPS Law. So it can be concluded that carrying out Electronic Arbitration in Indonesia during the COVID-19 pandemic is very helpful for business actors to be able to resolve their disputes because the convenience of these electronic devices makes business actors more efficient in running their companies.
Tujuan dari penulisan artikel ini adalah untuk mengetahui bagaimana pelaksanaan dari putusan perkara perdata yang telah mempunyai kekuatan hukum yang tetap (in kracht van gewijsde). Dan hambatan-hambatan non yuridis dan yuridis yang dapat terjadi pada saat pelaksanaan putusan perkara tersebut. Metode yang digunakan dalam penulisan ini adalah metode penelitian hukum normatif atau normative legal research dengan menggunakan pendekatan analistis dengan menganalisis asas hukum, kaidah hukum, dan sistem hukum yang ada pada peraturan perundang-undangan, serta didukung dengan data-data sekunder berupa hasil karya ilmiah dan hasil penelitian. Dengan hasil studi menunjukkan tata cara pelaksanaan putusan perkara perdata yang telah mempunyai kekuatan hukum tetap yang dilakukan oleh pengadilan negeri yang pelaksanaannya seringkali menjumpai beberapa hambatan-hambatan seperti hambatan yuridis yang berupa adanya PK atau peninjauan kembali yang diajukan oleh termohon eksekusi kepada Mahkamah Agung dan adanya Derden Verzet yang diajukan pihak ketiga sebagai perlawanan yang diajukan sebelum dilakukan eksekusi. Dan hambatan non yuridis seperti berpindah tangannya objek eksekusi atau objek eksekusi bukan lagi milik termohon eksekusi. Dan sebagai pencegahan hambatan yang akan terjadi, Pengadilan Negeri dapat meminta bantuan kepada aparat hukum seperti TNI dan Polri agar prosedur eksekusi dalam pelaksanaannya dapat berjalan dengan lancar dan tidak ada yang menghalangi jalannya proses eksekusi. The purpose of writing this article is to find out how the implementation of civil case decisions that have permanent legal force (in kracht van gewijsde). And non-juridical and juridical obstacles that can occur during the implementation of the case decision. The method used in this paper is a normative legal research method or normative legal research using an analytical approach by analyzing the legal principles, legal rules, and legal systems that exist in the legislation, and supported by secondary data in the form of scientific works and research result. With the results of the study showing the procedure for implementing civil case decisions that have permanent legal force carried out by district courts whose implementation often encounters several obstacles such as juridical obstacles in the form of a PK or judicial review submitted by the defendant to the execution of the Supreme Court and the existence of Derden Verzet submitted by a third party as a resistance submitted before execution. And non-juridical obstacles, such as changing hands, the object of execution or the object of execution no longer belongs to the defendant's execution. And as a prevention of impediments that will occur, the District Court can ask for assistance from legal apparatus such as the TNI and Polri so that the execution procedure in its implementation can run smoothly and nothing hinders the execution process.
