This study intends to understand the effects of the translation made by Brazilian legal culture of the concept of administrative law in the nineteenth century. Taking into account the peculiarities of the historical context in which the concept develops in Europe and is implanted in Brazil, it analyzes legal doctrine in order to verify the peculiarities of the conceptual constructions elaborated by these specific legal cultures. It concludes that, built in Europe as an instrument of uninterrupted action by Administration aiming at the realization of the general interest as a means to achieve economic and military strengthening in the context of international competition, in Brazil it plays the constituent function of founding the legitimacy for the newly created Brazilian State, in the context of political rupture.
