2019 yılı itibariyle Türkiye’de nüfusun %63’ünün sosyal medya kullanıcısı olduğu tahmin edilmektedir. Bu oran azımsanamayacak kadar yüksektir. Bununla birlikte gün geçtikçe daha fazla sosyal medya hesabı sahibinin öldüğü de bir gerçektir. Ölüm halinde murisin parayla ölçülebilen mal ve hakları mirasçılarına intikal etmektedir. Ancak ölümle birlikte sosyal medya hesaplarının durumu belirsizdir. Sosyal medya hesaplarının kullanımına ilişkin sözleşmeler bir şirket ve kullanıcı arasında kurulmaktadır. Bu sözleşmeler uyarınca şirket, kullanıcının ve kullanıcının iletişim kurduğu kişilerin verilerini korumakla yükümlüdür. Bu durumda miras hukukunda yer alan intikal hükümleri ile kişisel verileri koruma yükümlülüğü arasında çatışma meydana gelmektedir. Nitekim yargıya yansıyan olaylarda da mahkemeler, sosyal medya hesaplarının mirasçıya intikal edip edemeyeceği noktasında kişisel verileri koruma ve miras hukuku ilkelerini birlikte değerlendirmiştir. Bu itibarla çalışmamızda, öncelikle kişisel veri kavramı, hukuki niteliği ve önemi açıklanmaktadır. Ardından sosyal medya sözleşmeleri incelenmektedir. Nihayet miras hukuku açısından sosyal medya hesaplarının miras yoluyla intikale elverişli olup olmadığı ele alınmaktadır. Böylelikle çalışmamızda kümülatif olarak kişisel verilerin korunması yükümlülüğünün sosyal medya hesaplarının miras yoluyla intikale engel olup olmadığı değerlendirilmektedir.
Demand of Transfer of Land Ownership by the Owner of the Meterial, in the Case of Unjust Contruction Built with the Constructor's Own Meterial on a Land Belonging to Another (TMK m. 724) Vehbi Umut ERKAN ÖZET Haksız yapı kurumu, TMK m. 722, 723 ve 724'de hüküm altına alınmıştır. Söz konusu hükümler uyarınca haksız yapının bir türünü de malzeme sahibi tarafından kendi malzemesini kullanarak başkasının arazisinde haksız yapı meydana getirilmesi oluşturmaktadır. Kendi malzemesini kullanarak başkasının arazisinde haksız yapı meydana getirilmesi durumunda malzeme sahibine, tazminat (TMK m. 723) ve arazinin tamamının veya yeterli bir kısmının mülkiyetinin kendisine verilmesini (TMK m. 724) talep etme hakları tanınmaktadır. Bu kapsamda olmak üzere çalışmamızın konusunu malzeme sahibine tanınan arazinin tamamının veya yeterli bir kısmının mülkiyetini talep etme hakkı oluşturmaktadır. TMK m. 724 uyarınca, malzeme sahibince, arazinin mülkiyetinin tamamının veya belirli bir kısmının mülkiyetinin devredilmesinin talep edilebilmesi için ise devri talep eden malzeme sahibinin, iyiniyetli olması ve yapının değerinin arazinin değerinden açıkça Çalışma, 16.01.2013 tarihinde savunulan ve jüri tarafından başarılı bulunan, "Türk Medeni Kanunu'nda Kendi Malzemesini Kullanarak Başkasının Arazisinde Haksız Yapı Meydana Getirilmesi (TMK m. 722-723-724)" isimli doktora tezinden türetilmiştir.
ÖzetKarşılaştırmalı hukukun işlevsel denklik ilkesi bir hukuk düzeninde somut hukuki soruna getirilen çözümden yola çıkılarak, bir başka hukuk düzeninde o kuruma işlevsel olarak denk hukuk kurumlarının tespitini gerektirir.De minimis, özellikle Amerikan hukukunda sıklıkla yargı tarafından başvurulan bir kurumdur.Bu kurum, önemsiz zararların tazmin edilmemesini veya dava edilememesini sağlamaktadır. Buna karşılık yazılı hukuk kurallarını hukukun birincil kaynağı olarak kabul eden kıta Avrupası ülkelerinde açıkça de minimis kuralı olarak nitelendirebileceğimiz bir kurala rastlanmamaktadır.Anglo-Amerikan hukukunda sıklıkla kullanılan bu kurumun, kıta Avrupası hukuk düzenlerinde birebir karşılığı bulunmasa da, karşılaştırmalı hukuk bakış açısıyla yaklaşıldığında aynı işlevi gören kuralların izlerini tespit etmek mümkündür. Özellikle haksız fiiller ve komşuluk hukukundaki bazı düzenlemelerin, önemli ve önemsiz zararlar ayrımı yaptığı görülmektedir.Avrupa Birliğinde bazı alanlarda hazırlanan direktifler, üye ülkelerin bu kurumu iç hukuklarına almaları sonucunu doğurmuştur. Bunlardan en bilinenleri rekabet hukukuna ilişkin düzenlemeler, ayıplı ürünlerin neden olduğu zararlardan doğan düzenlemeler ve fikri haklar alanında yapılan düzenlemelerdir.De Minimis kuralına Avrupa'da hukukun birleştirilmesi çalışmaları kapsamında da yer verildiği görülmektedir. Tapu sicili sistemine hâkim olan ilkelerden tapu sicilinin açıklığı ilkesine göre, tapu sicili herkese açıktır. Ancak, bir kimse başkasına ait tapu sicili bilgilerini incelemek ya da bu sicilden örnek almak isterse ilgisini inanılır kılması gerekir. 4982 sayılı Bilgi Edinme Hakkı Kanunu’na (BEHK) göre, Türk vatandaşı olan gerçek kişiler ile Türkiye’de tescilli tüzel kişiler, ilgisini inanılır kılmasına gerek olmaksızın hem kendisiyle ilgili hem de bir başkasıyla ilgili bilgiye veya belgeye kolaylıkla ulaşabilme imkanına sahiptir. Bilgi edinme hakkı ile tapu sicilinin açıklığı ilkesine ilişkin TMK m. 1020/II hükmü, kişinin kendisiyle ilgili tapu sicil bilgilerini istemesi halinde birbirini tamamlayıcı niteliktedir. Ancak, başkasına ait tapu sicil bilgilerinin istenmesi durumunda bilgi edinme hakkı ile TMK m. 1020/II hükmü arasında ilk bakışta bir çatışma varmış gibi görünmektedir. Bu nedenle her iki kurum arasındaki ilişki ve aralarında bir çatışma olup olmadığının değerlendirilmesi gerekmektedir. Bu bakımdan çalışmamızda, bilgi edinme hakkı ve tapu sicilinin açıklığı ilkesine ilişkin bilgilere yer verilerek, BEHK’de yer alan hükümlerle TMK m. 1020/II hükmünün arasındaki ilişki ve buna bağlı olarak TMK m. 1020/II hükmünün zımnen yürürlükten kalkıp kalkmadığı hususu değerlendirilmiştir.
