Resumo:O conceito de raça, etimologicamente, origina-se do termo latim ratio e denota a categorização de espécies. Ocorre que a distinção inicialmente realizada em bases científicas estritas extrapolou o campo do saber e passou a ser tratada como projeto social para a evolução da espécie. Os efeitos deletérios causados por esta distorção marcam diversas sociedades, entre elas a brasileira. Entender como o conceito de raça migrou das bases científicas para a estrutura social e como este ato impacta a sociedade moderna é o escopo do presente artigo.

o sistema jurídico, em uma “modernidade periférica” marcada por graves problemas estruturais na distribuição de bens e riquezas, é cotidianamente chamado a superar as falhas operativas de outros sistemas sociais. Não raras vezes seu centro decisório responde a estas invocações com comunicações que espelham a “judicialização da vida”. Não parece ser o caso dos conflitos fundiários que, conforme atestam estudos do CNJ, culminam em atos de violência. O presente estudo visa analisar os eventuais motivos pelos quais o centro decisório do direito não é visto como arena eficiente para solucionar os conflitos fundiários encampados pelos movimentos sociais, bem como quais as oportunidades de abertura cognitiva a aproximação do movimentos sociais fundiários com o centro decisório do direito podem proporcionar.
Resumo O ensaio apresenta e correlaciona as perspectivas teóricas de Niklas Luhmann e Ludwing Wittgenstein a respeito dos conceitos de sistemas de comunicação e jogos de linguagem, enfrentando as principais diferenças e semelhanças que possam ser encontradas nos trabalhos desenvolvidos por estes dois pensadores modernos. Pela estreita via de um ensaio, o estudo se limitará à revisitação bibliográfica, sem a pretensão de seu esgotamento, buscando, contudo, clarear a forte intuição de que há entre os dois pensadores uma implicação recíproca, uma vez que os jogos de linguagem de Wittgenstein remetem a uma necessária teoria da diferenciação, enquanto que a teoria dos sistemas de Luhmann implica no surgimento de uma gramática própria aos sistemas funcionais. A partir de uma estreita colaboração interdisciplinar entre sociologia do direito e teoria do direito, Niklas Luhmann propõe a renovação das observações do princípio evolutivo do direito, afastando-se das perspectivas naturalistas e historicistas. A perspectiva apresentada neste artigo se embasa na abordagem luhmanniana, segundo a qual a evolução vem concebida como acréscimo de complexidade, em outros termos, incremento da diversidade de situações e dos eventos possíveis. Expor o caminhar desta perspectiva evolutiva e os efeitos para a compreensão da formação do sistema jurídico moderno são os objetivos deste artigo. Ao final, chega-se à conclusão de que, apesar de não se poder compreender evolução como um caminho sem volta, a formação do sistema jurídico moderno dependeu de condições sociais pelas quais o direito especificou suas próprias estruturas. São apresentadas ao leitor as “conquistas evolutivas” conferidas pelo desenrolar histórico ao sistema jurídico para que se chegasse à configuração hodierna.
