National identity of EU member state as a reason for granting a different level of fundamental rights protection in comparison with the Charter of Fundamental Rights of the EU The presented paper deals with the question of whether the wording of Article 4(2) of the Treaty on European Union allows the EU Member States to grant a different level of fundamental rights protection in comparison with the level of protection granted by the Charter of Fundamental Rights of the EU. The first part of the paper is dedicated to the caselaw of the Court of Justice of the EU concerning the Member State's possibility to apply a higher level of fundamental rights protection in comparison with the Charter, as well as to considerations as to the potential possibilities to apply the higher level of fundamental rights protection as a result of respecting the Member State's national identity. The second part of the paper deals with the possibility of limiting the fundamental rights enshrined in the Charter in order to protect the Member State's national identity. In conclusion, the paper offers some summary considerations as to the Member States' potential possibilities to apply a different level of fundamental rights protection from the point of view of the Court of Justice of the EU.
After the inclusion of the EUʹs obligation to respect national identities of its Member States into the primary law of the European Union, the notion of national identity has become an object of the interest of constitutional courts of EU Member States. They have, at the same time, started to use the notion of constitutional identity with regard to the European integration in their case-law. The object of this article is to analyse the case-law of the constitutional courts of the Visegrad group regarding the notions of national identity and constitutional identity and to analyse the means of using these concepts in their case-law, in particular with regard to the use of the concept of national identity within the meaning of the Article 4 (2) of the Treaty on European Union in the case-law of the Court of Justice of the European Union. ABSTRAKT Po tom, čo bola v primárnom práve Európskej únie ustanovená povinnosť Únie rešpektovať národné identity jej členských štátov, sa stal pojem národná identita čoraz častejším objektom pozornosti ústavných súdov členských štátov Únie. Súčasne sa v judikatúre týchto súdov začal v súvislosti s európskou integráciou používať pojem ústavná identita, mnohokrát spájaný práve s národnou identitou. Cieľom tohto článku je priblížiť judikatúru ústavných súdov štátov Vyšehradskej skupiny zaoberajúcu sa pojmami národná identita a ústavná identita a zhodnotiť spôsob, akým sú tieto koncepty v ich judikatúre využívané, a to predovšetkým s ohľadom na využitie konceptu národnej identity v zmysle článku 4 ods. 2 Zmluvy o Európskej únii v judikatúre Súdneho dvora Európskej únie. 8 Article 6(3) TEU in the wording of the Amsterdam Treaty stated: "The Union shall respect the national identities of its Member States." 9
V prvom polroku tohto roku sa v Košiciach uskutočnila vedecká konferencia: „15 rokov v Európskej únii: aktuálne otázky a súčasné výzvy“, príspevky z ktorej sú obsiahnuté v predkladanom rovnomennom Zborníku. Zámerom jej tradičného organizátora tj. UPJŠ v Košiciach, Právnická fakulta, Ústav medzinárodného práva a európskeho práva bolo tematicky nadviazať na predošlú konferenciu z r. 2014 „10 rokov v EÚ - Vzťahy, otázky, problémy“ a s odstupom piatich rokov opäť poskytnúť záujemcom priestor na analýzu a výmenu názorov na problémy späté s vplyvom a uplatňovaním ako úniového práva v Slovenskej republike tak aj s aktuálnymi výzvami, ktoré prinieslo úniové právo v období posledných piatich rokov. Obsahovo a tematicky rôznorodé príspevky skúmajú vzťah úniového práva a vybraných ustanovení Ústavy Slovenskej republiky, aktuálne problémy prejudiciálnych otázok v činnosti Ústavného súdu Slovenskej republiky a úlohu úniového práva v konaní o súlade právnych predpisov, pričom v pomerne značnom počte skúmajú autori príspevkov vplyv úniového práva na vybrané oblasti slovenského právneho poriadku napr. v oblasti audiovizuálnych mediálnych službách, procesných práv jednotlivca v oblasti environmentálnych práv, v práve obchodných spoločností, konkurzného práva, trestného práva, ochrany ľudských práv a i.. Z príspevkov zahraničných účastníkov možno spomenúť ten, ktorý je venovaný európskej legislatíve v praxi českej Poslaneckej sněmovne. Po tretej “päťročnej“ konferencii venovanej úniovému právu jej organizátori s potešením konštatujú rastúci záujem akademickej obce o problematiku úniového práva a predovšetkým jeho vplyvu na vnútroštátne právne poriadky jednotlivých štátov. Rastúci záujem o túto tému sa neprejavil len v počte prednesených príspevkov, ale aj vo vysokej odbornej úrovni ich spracovania a podnetnej diskusii. Zostavovatelia zborníka preto dúfajú, že predkladaný zborník sa stane hodnotným študijným prameňom ako pre vážnejších záujemcov o úniové právo, tak aj súčasťou odporúčanej literatúry na výučbu európskeho práva alebo jeho špecializovaných kurzov na právnických fakultách.
