El artículo analiza el rol del grupo de antropólogos que trabajan en el cumplimiento a una orden judicial sobre protección a pueblos indígenas en riesgo de exterminio por cuenta del conflicto armado, al interior de la Dirección de Asuntos Indígenas del Ministerio del Interior en Colombia. A través de un trabajo de campo de diez meses, enfocado sus rutinas laborales y obligaciones contractuales, la investigación encuentra que su quehacer no es el despliegue de su experticia profesional sobre los problemas de los indígenas en tanto insumo para tomadores de decisión, sino el gestionar e intermediar en los procesos administrativos vinculados a la concertación entre los indígenas y las demás instituciones gubernamentales. Asimismo, el artículo destaca que, si bien, su posición tiene un margen de maniobra limitado, es a la vez un rol complejo, por la multiplicidad de posiciones que deben asumir en tanto mediadores y que los ponen en la encrucijada entre lo que aprendieron como antropólogos, lo que deben hacer como representantes del estado y lo que hacen como ciudadanos. Finalmente, propone que esta labor, limitada y a la vez compleja, refleja un cambio en el quehacer de los antropólogos en la interacción entre el estado y los indígenas.
In 2009, through Court Order 004, the Colombian Constitutional Court declared that thirty‐four separate groups of Indigenous peoples were at risk of extermination due to armed conflict, and it ordered the government to protect them. In 2013, the court then ordered the government to prove its compliance with Order 004. The government did so through a complex documentation process. The production of documents in Colombia not only records compliance but also constitutes compliance even if the actions are limited. In this article, I examine the role of documentation in mediating legal protection in a violent context. How does a governmental report obscure a persisting threat that is mostly ignored? Using participant observation at the Colombian Interior Ministry on the government's response, I illustrate how this documentation converts ordinary governmental actions into restitution of rights and manufactures compliance via the display—and concealment—of numbers through a focus on aesthetics. This generates the effect of sufficient state response while obfuscating the failure to achieve any intended changes: a phenomenon that I term complying incompliantly. Transforming negligence into a proper response through a paper trail outsmarts auditing and maintains the state's legitimacy by normalizing the government's shortcomings. This article contributes to the analysis of the relationship among law, documentation, and transparency. [Colombia, Indigenous peoples, human rights, documentation, compliance]
Con este encuentro quisimos poner a dialogar nuestra experiencia etnográfica en escenarios estatales con la conceptualización desarrollada en el artículo "'El desplome de lo igual es irreversible'. La emergencia del enfoque diferencial étnico en Colombia". El propósito es profundizar en algunas líneas analíticas sugeridas que merecían ser desarrolladas. Por una parte, deseamos explorar más los horizontes históricos del surgimiento del enfoque diferencial, así como situar mejor el lugar de algunos actores clave. También, analizar el traslape del enfoque diferencial étnico con otros instrumentos políticos de reconocimiento, para señalar sus tensiones y puntos de fuga. Y, por último, identificar el lugar del enfoque diferencial en la racionalidad gubernamental con la que se responde a los compromisos adquiridos en escenarios de concertación producto de órdenes judiciales.
