In the legislative system, Pancasila is a basic norm (staatsfundamental), which successively then verfassungnorm UUD 1945, grundgezetznorm or MPR provisions, and gezetznorm or the Act. But in reality, Pancasila is equalized and equated with the 1945 Constitution, the Unitary State of the Republic of Indonesia, Bhinneka Tunggal Ika, which is then referred to as the Four Pillars of Nation and State. The Constitutional Court as the constitution gatekeeper institution returns the position of the Pancasila as the state foundation through the Decision of the Constitutional Court Number 100/PUU-XI/2012. The decision is part of the implementation of the authority of the Constitutional Court which has 4 (four) authorities and 1 (one) obligation as stipulated in Article 24C paragraph (1) and paragraph (2) of the 1945 Constitution. Namun dalam kenyataannya, Pancasila disamakan kedudukannya dan disejajarkan dengan UUD 1945, Negara Kesatuan Republik Indonesia, Bhinneka Tunggal Ika yang kemudian disebut dengan istilah Empat Pilar Berbangsa dan Bernegara. Mahkamah Konstitusi sebagai lembaga penjaga gawang konstitusi mengembalikan kedudukan pancasila sebagai dasar negara melalui Putusan Mahkamah Konstitusi Nomor 100/PUU-XI/2012. Putusan tersebut merupakan bagian dari pelaksanaan kewenangan Mahkamah Konstitusi yang mempunyai 4 (empat) kewenangan dan 1 (satu) kewajiban sebagaimana diatur dalam Pasal 24C ayat (1) dan ayat (2) UUD 1945. Selain sebagai lembaga negara pengawal demokrasi, Mahkamah Konstitusi juga sebagai Pelindung dasar negara dan sumber hukum.
In a democratic country the relationship between the state and the people must be a reflection of a mutualistic symbiosis. This means that these relationships must be mutually dependent and mutually beneficial. This relationship will be evident when the political system developed by a country provides sufficient space for political activities in the community. This space for political activity will give color to democratic life in a country. The principle of democracy and people's sovereignty requires people's participation in the life of the state administration. People or citizens are not only objects, but subjects and play an important role in the life of the state. For this reason, the existence of a representative institution is an absolute that must be fulfilled in a democratic country with people's sovereignty. According to modern democracy, political parties, general elections and representative institutions are three institutions that cannot be separated from one another. That every political party will always strive to gain large popular support during general elections so that the representative institution can be dominated by the political party concerned.Keywords: political parties, general elections, democracy.
For the modern state, the constitution must be understood as a development concept. The constitution can not be viewed as a static document, but it lives and grows as the basic principle of the state organization that always followes the developments and dynamics of society. The constitution was born from constitutionalism which provides limits of state power in one side and guarantee for the rights of people through constitutional provisions in another side. During 74 years of Indonesia's independence, the constitution give the color in the organization of state administration. Many important events woven in 3 (three) constitutions in this period, namely the Constitution of 1945, the Constitution of 1949 United Republik of Indonesia and Provisional Constitution of 1950. Departing of the view that the constitution should follow the development and dynamics of society, this paper will explore the journey of life about the constitution of the early independence to this present era. For a dynamic society, creation of awareness constitution is very important, because the constitutional talks in the future will increasingly contentious and polemical as in previous years.
Tersurat dan tersirat dalam Konstitusi Indonesia, penegasan bahwa selain sebagai negara hukum seperti tertera dalam ketentuan Pasal 1 ayat (3) UUD 1945, maka Indonesia adalah juga negara demokrasi, yaitu negara yang berkedaulatan rakyat seperti tertuang dalam ketentuan Pasal 1 ayat (2) UUD 1945. Sebagai negara berpostur negara hukum demokratis tentunya segala langkah kebijakan yang diambil akan bermuara pada tujuan bagaimana mewujudkan tata kehidupan masyarakat hukum yang bersendikan nilai-nilai demokrasi. Merayakan 77 tahun kemerdekaan Indonesia, serta diilhami oleh fenomena meningkatnya kesadaran pentingnya negara hukum dan tegaknya demokrasi, maka perlu dikaji bagaimana derap politik hukum dalam tata hukum Indonesia guna mewujudkan masyarakat hukum yang demokratis. Politik hukum sebagai bagian dari sekian banyak kebijakan penguasa negara akan sangat menentukan warna tata hukum yang berlaku dalam kehidupan bernegara dan bermasyarakat. Tata hukum yang merupakan wujud dari aspirasi publik, juga akan menentukan tercapai tidaknya suatu masyarakat hukum ideal dalam ukuran dan ranah demokrasi.
Sejak kemunculannya di Wuhan Cina pada awal 2020, Covid-19 melanda semua negara di dunia, yang berpengaruh langsung terhadap perikehidupan warga dunia di berbagai negara. Tidak hanya sektor kesehatan, tetapi terutama juga adalah sektor perekonomian, pariwisata dan pendidikan. Semua pemerintahan negara-negara di dunia menentukan regulasi (kebijakan) dan mempersiapkan anggaran untuk menanggulangi dampak yang lebih meluas dari merebaknya pandemi ini. Langkah ini diambil oleh Indonesia, maupun Jepang. Berbagai kebijakan dan anggaran masa krisis ini tentu harus mendapatkan perhatian dari sisi bagaimana tata kelola dan akuntabilitasnya. Maka hendak dicari jawaban perbandingan dampak dan tantangan regulasi, tata kelola dan akuntabilitas anggaran untuk merespon pandemi Covid-19 antara Indonesia dan Jepang. Penelitian yang mengunakan kombinasi penelitian lapangan field research dan library research ini bersifat bersifat deskriptif analitis, yaitu mendiskripsikan dan menganalisis dampak dan upaya penanggulangan Covid-19 dari sisi regulasi dan anggaran. Penelitian ini menggunakan model studi kasus kebijakan dan tata kelola anggaran terkait Covid-19 di Indonesia dan Jepang. Jadi kebijakan dan tata kelola anggaran terkait Covid-19 menjadi subyek penelitian ini. Kesimpulan yang dapat diambil adalah bahwa kedua negara sama-sama merasakan dampak Covid-19 dalam berbagai sektor, seperti terutama sektor kesehatan, tetapi juga sektor perekonomian dan ketenagakerjaan, industri pariwisata, dan sektor pendidikan. Meskipun kedua negara sama-sama menentukan regulasi dan anggaran krisis untuk menanggulangi dampak Covid-19, letak dan kondisi geografis, luasnya wilayah Indonesia yang tersebar dalam ribuan pulau, banyaknya dan heterogennya jumlah penduduk, serta budaya masyarakat dan pemerintahan yang berbeda dengan Jepang menyebabkan perbedaan langgam dalam penanganan dan penanggulangan pandemi Covid-19 di kedua negara.
