Regulation – a notion first borrowed from the natural sciences by economists and then from economists by lawyers – has become increasingly common in international law. Within this article, we attempt to define the main features of international regulation. To do so, we will retrace, although not exhaustively, the path of the successive applications of this notion through its implementation in two major legal models. This will be a necessary step in defining its distinctive criteria. Thereafter, we will analyze the feasibility of employing these criteria into international regulation to determine whether the phenomenon observed within domestic legal systems is actually the same phenomenon or a completely different one.
O ensaio explora e fomenta, desde uma visão histórico-funcional da propriedade fiduciária romanística e o trust de origem inglesa, o diálogo entre duas das maiores tradições jurídicas do mundo ocidental: a tradição de base romanística e a tradição baseada no Common Law. Por meio de um estudo baseado em fontes primárias e secundárias, busca-se traçar, de um lado, o desenvolvimento histórico da fiducia (cum amico e cum creditore) e, de outro, a elaboração jurisprudencial e estatutária do trust inglês (desde os uses medievais até o conceito atual do instituto, passando pelo Statute of Uses 1536). A seguir, mostra-se a estrutura jurídica básica, no Brasil, da propriedade fiduciária (e do seu consectário lógico, a propriedade resolúvel), a fim de proceder a uma comparação com o trust inglês e estabelecer relações de sentido entre essas duas figuras jurídicas.
