Pasal 200 UU No. 36/2009 Tentang Kesehatan mengatur bahwa setiap orang yang dengan sengaja menghalangi pelaksanaan program ASI eksklusif diancam dengan sanksi pidana. Walaupun demikian, penegakan hukum atas pasal ini belum berjalan dengan baik. Di lain pihak ibu menyusui adalah subjek sentral dari pelaksanaan ketentuan ini. Penelitian ini membahas mengenai mengapa penegakan hukum Pasal 200 belum berjalan namun dilihat dari aspek budaya hukum ibu menyusui sebagai elemen penting bagi penegakkan hukum. Kesimpulan penelitian ini adalah bahwa budaya hukum responden ibu menyusui merupakan salah satu factor yang mendasari keputusan responden untuk tidak menggunakan Pasal 200 ketika hak nya dilanggar
Abstract In criminal justice system, it is important to make sure that the rights of the inmates are both protected and properly fulfilled. This is even more essential in the case of inmate children, bearing in mind all the aspects attached on them. The rights are regulated in the Art.4 of Law No. 11/2012 on Criminal Justice System for Children’s Court and and also Art 22 Law No 12/1995 on Correctional Institution. This research observes and analyzes how is the implementation of those rights in Special Correctional Facilities for Children Class 1A Tangerang. The method used is yuridis-empiris which dominated by observation and interviews. The result of the study is that the Special Correctional Facility observed has carried out the rights for inmate children in a suffice manner which comprises right for education, access to health, legal aid, access to information and others.
Medical negligence in Indonesia can be considered as criminal conduct. Though the nature of medical contract—relationship is private, but it is considered to have public aspects. The criminalization of medical negligence is intended to protect citizen from any malpractice by medical workers. While there are enough lawsuits and cases being reported to the police, yet the conclusions are still in the shadow. There are some rules regarding some standards, either it is on the medical treatment procedures, or on the terms and procurements of the medical workers. Interestingly, failing on these standards come along with criminal punishment on. Yet, in some cases, we found out that criminal punishment being ruled out. Instead, the proceeding uses restorative justice. Restorative justice is a state of the art criminal proceeding that weighing on repairing damages on victim, caused by criminal conduct—than to punish the perpetuator. Using theories within the Criminal Study like the “goals of punishment”, justice theories, and restorative justice theories as well; we conclude that the switch of punishment into other obligation for victim’s sake is a good application of restorative justice
regional laws in a comparative perspective. The selection of the two laws is based on the preliminary study which found a quite unique form of criminal provisions on each laws. The analysis is also based on art 200 and 201 Law No. 36/2009 and its derivative regulations as a normative measurement in national level, with which the two regional laws must be in line to. This research found that there are quite a significance differences between the two laws especially regarding the form of action that is criminally regulated. Variation also found on how the two laws fulfil what is demanded by the national criminal policy.
The teachings of error in Criminal Law Science are divided into two namely intentional and negligence. Both of these are different in principle as an element of subjective crime. Deliberation according to the von Hirsch doctrine deserves a higher sentence than negligence. Various kinds of offenses that also emphasize the difference in weight and type of threat of sanctions for these two mistakes. The practice of medicine is very risky to cause suffering for patients, especially if not done professionally. In Indonesian Criminal Law there are offenses relating to this practice. In these offenses, there is an element of negligence that has the threat of a more severe sentence than intentional offense. This situation shows the design of the formulation of offense and the threat of disproportionate punishment.
