Este artigo tenciona demonstrar que o Poder Judiciário realiza Política Criminal por meio de suas decisões. Para concretizar o debate e verificar quais critérios e fundamentações estão sendo levantados na prática judicial, serão apresentados os resultados da pesquisa jurisprudencial realizada nas varas criminais do município de Campinas - SP, a respeito da aplicação do princípio da insignificância no crime de furto, especificamente as trinta e duas sentenças proferidas pela 2ª Vara Criminal, que mais decisões proferiu acerca da problemática investigada. Desta análise resultou que o Poder Judiciário atua politicamente ao reavaliar e ressignificar, no caso concreto, a relevância penal da conduta furtiva, tendo esta atuação judicial no município de Campinas se mostrado bastante subjetiva, o que se depreende tanto pelo conjuramento de fundamentações pertencentes à convicção íntima do julgador sobre bem jurídico penal relevante e conduta reprovável, quanto pela ausência do imperativo constitucional da motivação em grande parte das decisões.
