In recent years, individuals study and work from home with some degree of normality. Technology and the Internet have become an essential part of life. This increased reliance on technology and constant engagement with the online world has its negative repercussions. However, it has increased the number of offenders involved in cybercrimes. Considering the aftermath of cybercrimes and the need to address the impact of cybercrimes on victims, this paper reviews the existing mechanisms, such as legislation, international frameworks and conventions. The main purpose of this paper resides in the discussion of the possible use of restorative justice in supporting the needs of the victims. Taking into consideration the cross-border nature of many of these offences, other solutions have to be considered in order to give the victims a chance to be heard and to heal the wounds caused by the crime. This paper argues for the use of victim-offender panels, which are meetings between a group of cyber victims and a group of convicted cyber offenders, allowing victims to express the harm caused by the crime, to be healed and giving room for the offenders to feel remorse, lessening thus the likelihood of recidivism, under the umbrella of reintegrative shaming.
O presente trabalho pretende analisar o nível de tutela conferida à vítima pelo Estatuto de Roma, que criou o Tribunal Penal Internacional, o qual abarca tanto uma vertente substantiva como processual, tendo levado em linha de conta os Estatutos, bem como as decisões tomadas pelos Tribunais Penais Internacionais ad hoc para a ex-Jugoslávia e para o Ruanda. Sucede, porém, que estes pecavam por não preverem um verdadeiro modelo em prol da vítima, pelo que o Estatuto de Roma, conjugado com o seu Regulamento de Procedimento e Prova, veio aditar um conjunto de medidas cruciais que visam proteger as vítimas e testemunhas, dar-lhes a possibilidade de participarem no processo e, ainda, garantir a reparação. Revela-se, pois, como um paradigma a ser levado em linha de conta pelo legislador interno, independentemente de o respetivo Estado ser ou não parte deste instrumento de Direito Internacional. Concluímos que o papel desempenhado pela comunidade internacional nesta chamada de atenção para a vítima deve ser levado em linha de conta em sede interna permitindo assim, com Nils Christie, que à vítima seja devolvido um conflito que é o seu. O presente estudo emprega uma metodologia qualitativa, atendendo essencialmente à doutrina e partindo da análise da inovação trazida pelo Tribunal Penal Internacional sobre esta temática. A hipótese que nos orienta reside na assunção de que o modelo apresentado pelo Estatuto de Roma em prol das vítimas tem potencial para ser levado em consideração pelo legislador interno.
Este artigo divide-se em três partes. A Parte I (O sistema constitucional das Regiões Administrativas Especiais de Hong Kong e Macau) fornece o enquadramento histórico das Regiões Administrativas Especiais de Hong Kong e Macau e introduz as ordens constitucionais das Regiões Administrativas Especiais de Hong Kong e Macau da República Democrática da China existentes à luz do princípio “um país, dois sistemas”. É feita uma referência aos principais desenvolvimentos constitucionais ocorridos nas primeiras décadas de existências dessas regiões administrativas especiais. A Parte II (Cooperação judicial em matéria criminal nas Regiões Administrativas Especiais) explica como é que as referidas ordens constitucionais influenciam o quadro jurídico existente relativo à cooperação judicial em matéria criminal, o qual se aplica à cooperação com outros Estados ou territórios, mas não à cooperação entre as várias jurisdições existentes na China, cooperação esta para a qual não existem regras positivadas atualmente em vigor. Examinam-se as regras em vigor em Hong Kong e em Macau sobre a entrega de fugitivos para outros países. A parte III (A entrega de fugitivos à China continental) lida particularmente com a questão da detenção e entrega de cidadãos chineses de Hong Kong e Macau à China continental. Fornece uma visão geral dos casos vindos a público e do dilema jurídico criado pela falta de regras específicas relativas à entrega de fugitivos dentro do “um país”.
