En algunas legislaciones, el niño por nacer es considerado una persona, como resultado de la convicción de que la vida y la persona que la contiene surgen desde el momento de la concepción. En otras legislaciones, cuando alguien nace, está vivo y completamente separado de la madre, desde ese momento es una persona y un sujeto de derechos. Sin embargo, el hecho de que el feto todavía no tenga la condición de persona no implica que esté totalmente desprovisto de derechos. La Constitución colombiana reserva varios derechos, entre ellos el derecho a la vida, que, por cierto, en nuestra legislación se considera una persona desde el mismo momento de la fecundación. Sin embargo, aun cuando el niño no sea aún una persona, en virtud de la legislación vigente, el niño por nacer tiene derechos que deben ser salvaguardados por el Estado y su falta de protección debe dar lugar a procesos de reparación o responsabilidades internacionales. Este trabajo explora las condiciones en las que el feto puede ser reconocido como víctima y los mecanismos de reparación que eventualmente serían los más adecuados, basados en la jurisprudencia y otros precedentes.
