Ao longo do processo civilizatório, não causar danos e ampliar benefícios constituem aspiração comum às diferentes sociedades humanas. O presente artigo discute o “Princípio de Benefício e Dano” à luz da Declaração Universal sobre Bioética e Direitos Humanos da UNESCO (DUBDH). Considerando as preocupações relacionadas com as práticas de saúde, especialmente aquelas associadas à segurança dos pacientes, o estudo desenvolve uma análise crítica de alguns conceitos relacionados com esse princípio. Após um breve introdução sobre diferentes enfoques existentes sobre beneficio e dano, divide a abordagem em duas grandes partes, ambas contempladas no artigo 4 da DUBDH: suas implicações com as pesquisas clínicas e sua relação com cuidados indispensáveis à saúde das pessoas e tecnologias associadas. Vale realçar a incerteza conceitual, bem como a dificuldade em harmonizar danos e benefícios. É possível hipotetizar também que as razões morais que contestam o dano sobrepõem-se àquelas que questionam a ausência clara de benefícios
