Este estudo buscou identificar e examinar a natureza dos potenciais conflitos hídricos existentes nas bacias hidrográficas dos rios Itaúnas e São Mateus e avaliar os mecanismos de mediação de conflitos vigentes para prevenção e tratamento dos mesmos. Foi possível identificar grande quantidade de conflitos no período de escassez hídrica, principalmente relacionados à intervenção em área de preservação permanente e construção/ampliação de barragem, pois a atividade agrícola é fortemente presente nas bacias em estudo. Além disso, notou-se a falta de conhecimento da população com relação aos conflitos existentes e o tratamento por meio da repressão para mediação de conflitos adotado pela população, tendo em vista que a figura policial é mais acessível e popular. Por sua vez, a mediação de conflitos por meio de acordos de cooperação comunitária (ACCs), adotado pela Agência Estadual de Recursos Hídricos, ainda que não verificada sua efetividade, é vista como um instrumento de grande potencial, pois trata o conflito por meio do diálogo/cooperação, sendo esta uma maneira mais democrática, entretanto é fundamental o acompanhamento e fiscalização dos compromissos firmados nestes acordos, tendo em vista o grande número de atores envolvidos.
A defesa do direito à agua evidencia-se, cada vez mais, como campo de atenção e atuação do Serviço Social. Entre as várias demandas apresentadas pela questão, neste artigo discutimos a ação do/a Assistente Social na Política Nacional de Recursos Hídricos (Lei 9.433/97), especialmente nos conselhos e comitês de bacia, tendo como premissas: as competências e os compromissos profissionais da categoria, as determinações da PNRH, o controle social democrático determinado pela Constituição de 1988 e o agravamento da pobreza devido aos problemas ambientais. Atuar na perspectiva dos usuários pela defesa da garantia à água potável limpa e segura e ao saneamento - direitos essenciais para o gozo da vida e de outros direitos humanos, conforme reconhecido pela ONU em 2010, impõe três desafios à categoria: a) participar dos debates conceituais sobre meio ambiente e sustentabilidade; b) comprometer-se com o fortalecimento do controle social democrático PNRH; c) estimular a prática nessa área, considerando as dimensões teórico-metodológicas, técnico-operativas e ético-políticas da profissão.
