This paper aims to discuss and observe the legal practice of child protection, particularly, custody and the legal attitude in Muslim society and of the parents, specifically in Indonesia. Deploying a socio-legal approach, it is clear that theoretically, through a number of laws and regulations, the state has provided legal protection to children in terms of custody, as well as from violence. In practice, the legal rights to custody are hardly obtained by children in either legal decisions or executorial steps. The paper argues that the failure of this legal protection is due to the problem of case settlement in the Islamic (religious) court, which tends to be more administrative than judiciary, and that theoretically to provide justice, the work of judges must not only be certain, but also judicial. This paper also analyses the reasons why judges in Religious Courts tend to be more oriented toward administrative issues than judiciary ones. One reason is that the atmosphere of the Religious Courts (PA) now supports administrative decisions more than judicial ones.[Artikel ini membahas dan mengamati praktik hukum perlindungan anak khususnya penjagaan dan perilaku hukum pada orang tua dan masyarakat muslim di Indonesia. Terlepas dari pendekatan sosiologi hukum, secara teoritis negara memberikan perlindungan hukum pada anak dalam kerangka penjagaan dari kekerasan melalui sejumlah hukum dan peraturan. Dalam praktiknya, hak penjagaan sulit didapatkan oleh anak baik dalam bentuk putusan atau eksekusinya. Artikel ini menjelaskan bahwa kegagalan tersebut terkait dengan penyelesaian kasus di pengadilan agama, yang cenderung administratif daripada substantif, meski secara teoritis tetap mendorong keadilan, dan kerja hakim bukan hanya memberikan kepastian hukum tetapi juga kemanfaatan. Abstrak:Dalam menjalankan roda pemerintahan, belakangan ini beberapa pemimpin terjun langsung ke masyarakat untuk memahami kebutuhan rakyat secara langsung, populer sebagai blusukan. Konsep Blusukan ternyata memiliki akar dalam sejarah Muslim, meskipun di Indonesia baru popular belakangan ini. Nizam al-Muluk (Bani Saljuk) memanfaatkan blusukan dalam kepemimpinannya. Tulisan ini membahas kepemimpinan blusukan Nizam al-Muluk dan relevansinya terhadap Indonesia kontemporer. Blusukan setidaknya memiliki beberapa keistimewaan: pemimpin mendapatkan informasi paling mendesak dilakukan dari tangan pertama; informasi yang akurat memungkinkan formulasi solusi yang tepat; terbinanya kedekatan psikologis antara pemimpin dan rakyat. Jelas sekali bahwa ketiga aspek tersebut sangat dibutuhkan dalam realitas kepemimpinan Indonesia saat ini. This article discusses blusukan as practiced by Nizam al-Mulk and tries to see its relevance to contemporary Indonesian political leadership. Blusukan has some merits: it allows a leader to receive first-hand and right-from-the-spot knowledge; accurate information and knowledge help to formulate an accurate solution; and it facilitates a strong psychological tie between the leader and his subjects. Apparently these three aspects are of utmost important in the reality of contemporary Indonesian leadership.Kata Kunci: blusukan, Nizam al-Muluk, Daulah Abbasiyah.
Artikel ini mengkaji nilai salam dalam al-Qur’an melalui pendekatan tafsir tematik. Dari kajian yang dilakukan terhadap aayat-ayat salam dalam al-Qur’an dapat diketahui bahwa ucapan salam sejahtera disampaikan Allah swt. kepada para nabi-Nya, antara lain, nabi Nuh, Ibrahim, Musa, Harun dan Il-Yaasin, termasuk nabi Muhammad yang mereka sudah berhasil dalam menjalankan tugas masing-masing. Sebaliknya, nabi Isa menyampaikan salam do’a kepada Allah memohon keselamatan pada tiga pergantian hidup yaitu sewaktu dilahirkan, sewaktu dimatikan dan sewaktu nanti kelak menghadap Allah di padang Mahsyar. Dengan demikian, ternyata nilai salam begitu tinggi dalam pandangan Islam. Juga terdapat salam di kalangan masyarakat Jahiliyah apabila mereka bertemu dengan sesama temannya, yaitu “Hayakallah” artinya semoga umurmu panjang. Selain itu terdapat juga salam di kalangan orang Yahudi munafiq yang didasari permusuhan kepada nabi suatu salam yang tidak diajarkan Nabi kepada mereka yaitu “Assamu’alaikum” artinya semoga engkau celaka”. Seterusnya salam perdamaian diperintahkan Nabi agar disebarluaskan di kalangan masyarakat Islam dari yang muda kepada yang tua dari yang sedikit kepada yang banyak, dari yang berjalan kepada yang duduk, dari yang berkenderaan kepada yang berjalan kaki, dari yang melihat kepada yang tidak melihat, dari murid kepada guru, dari bawahan kepada atasan dan lain sebagainya. Problematika salam saat ini adalah lebih dimasyarakatkan oleh kalangan bawah dibandingkan kalangan atas sehingga hal itu menimbulkan kesan bahwa salam dalam Islam bernilai rendah padahal yang semestinya bernilai tinggi
Sabah adalah salah satu Negara bagian Malaysia terbesar kedua setelah Sarawak. Islam masuk ke Sabah secara intensif terjadi pada abad ke 16 M berasal dari kesultanan Brunei, dimulai dari kawasan pantai Barat Sabah. Sehingga kawasan tersebut menjadi bagian dari daerah kekuasaan Sultan Brunei yaitu pada masa Sultan Bolkiah (berkuasa 1485-1524 M) karena ia termasuk pemimpin yang suka berpetualangan ke berbagai wilayah disamping mendakwahkan Islam juga memperluas daerah kekuasaan. Persebaran penduduk melayu dan keuturunan raja-raja Brunei secara bertahap bermigrasi ke pantai Barat Sabah. Persebaran Islam di Sabah juga berasal dari pengaruh Kesultanan Sulu kepada penduduk lokal Sabah sekitar abad ke-17 M terutama di kawasan pantai Timur Sabah. Migrasi sebagian muslim dari kesultanan Sulu sebagai akibat dari tekanan dan serangan koloni Spanyol (1521-1898 M) di Philipina Utara (Luzon, Visayas) hingga ke Selatan (Mindanao, Sulu, Basilan, Tawi-tawi Cota-Bato). Mereka melakukan migrasi ke pantai Timur Sabah tidak lain karena letak georgrafis yang tidak terlalu jauh, namun juga untuk mendapatkan kehidupan yang lebh aman. Tulisan ini akan menguraikan lebih detil tentang persebaran Islam di Sabah sejak masa Kesultanan, masa kolonial dan perkemangan terkini dengan tinjuan sosio-historis.
This study discusses the history of the development of Islam in Brunei Darussalam. Brunei is the oldest kingdom in terms of acceptance of Islam as a religion that is permitted by the people or people of Brunei. The Brunei State makes Islam the foundation of the State.
