Pemberian kredit dilakukan melalui perjanjian utang piutang atau perjanjian kredit antara pemberi utang (kreditur) di satu pihak dan penerima utang (debitur) di pihak lain. Dalam pemberian kredit, kreditur mensyaratkan adanya suatu benda sebagai jaminan yang harus dipenuhi oleh debitur. Adapun jenis jaminan yang diberikan oleh debitor seperti jaminan fidusia. Jaminan Fidusia adalah hak jaminan atas benda bergerak baik yang berwujud maupun yang tidak berwujud dan benda tidak bergerak. Pasal 23 ayat (2) Undang-Undang Jaminan Fidusia, yang selanjutnya akan disebut UUJF menyatakan Pemberi Fidusia dilarang mengalihkan, menggadaikan, atau menyewakan kepada pihak lain benda yang menjadi objek Jaminan Fidusia yang tidak merupakan benda persediaan, kecuali dengan persetujuan tertulis terlebih dahulu dari Penerima FidusiaPenelitian ini menggunakan metode Yuridis Normatif yaitu mengacu kepada ketentuan - ketentuan peraturan perundang-undangan positif di Indonesia seperti Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia.Adapun hasil penelitian menyebutkan bahwa tanggungjawab pemberi fidusia yang telah mengalihkan benda jaminan fidusia dapat berupa Pidana, tetapi ada alternatif lain yaitu pemberi fidusia melakukan pembayaran hutang atau kredit kepada penerima jaminan fidusia hingga lunas hutang tersebut Kata kunci : Tanggung Jawab, Pemberi Fidusia, Perjanjian, Jaminan Fidusia
This study aims to analyze the legality of the electronic certificate of mortgage in the context of executing the guarantee if the debtor defaults or defaults if there is a data error in the bank credit agreement. The method used in this research is the literature method with reference to the normative juridical method, namely using data sourced from secondary legal materials, namely from the prevailing laws and regulations in Indonesia. The regulations used as material are the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 3 of 2019 concerning Electronically Integrated Mortgage Services. The research results show that the certificate generated from the electronic mortgage registration system has executorial power because the mortgage certificate contains the sentence for Justice Based on the One Godhead. The sentence shows that the mortgage certificate can be used as a tool for executing collateral if the debtor defaults or defaults to pay without a court order. Sentences for Justice based on the One Godhead are equated as a judge's decision in a court. If there is a data error in the certificate and no changes are made, the execution cannot be carried out and the certificate can be canceled and the agreement in guarantee can also be canceled.
This study aims to know and analyze, know and analyze the scope of management of State property. As well as knowing and analyzing the provisions of legislation related to the Indra Kenz case. This research belongs to the normative type of research. So it can be seen that in article 1 paragraphs (1) and (2) it is said in one pointnyes that other legitimate acquisitions can be based on court decisions that have obtained permanent legal force, for example is State Booty/Confiscation. In addition, the implementation of criminal law functions in the Indra Kenz case has been implemented properly and in accordance with what was expected in the Preamble to the 1945 Constitution.
There is a fundamental difference between land and agricultural land. The soil itself is the main component of land and has the bearing capacity so that it can withstand the weight of it and the raw materials for making various kinds of goods. While agricultural land is an area on the surface of the earth that has certain criteria such as atmosphere, soil, geological layers, hydrology, biosphere, and plant and animal populations. Based on the provisions of land law in Indonesia every land can be given rights, such as property rights. This study aims to find out and analyze the ownership rights to agricultural land and residence for married couples with different forms of marriage (mixed). This research was conducted using a normative juridical approach. Legislation, literature, publications, and periodicals on the marriage agreement are the legal sources used. The results of the research show that the provisions of the laws and regulations in Indonesia regarding ownership rights to agricultural land and residence for married couples with different nationalities must be based on the marriage agreement that was made. The form of the marriage agreement that is made contains the separation of assets owned by married couples of different nationalities. Because of Indonesian land law, which states that only Indonesian residents can acquire ownership rights to land.

This study aims to determine and analyze the implementation of compensation payments for land based on law number 2 of 2012 concerning land acquisition for development for the public interest. As well as knowing and analyzing obstacles to the implementation of compensation payments on land based on law number 2 of 2012 concerning land acquisition for development for the public interest. This research belongs to the normative type of research. So it can be known that these stages are planning, preparation, implementation, and submission of results. In addition, the process of providing compensation for land-owning communities must be carried out optimally, even the determination of the amount of compensation value must be carried out evenly.
