StreszczenieW artykule analizowano specyfikę i formy współpracy funkcjonariuszy pionu dochodzeniowo-śledczego * ze specjalistami z laboratoriów kryminalistycznych w postępowaniu przygotowawczym oraz istniejące problemy praktyczne tejże współpracy. W ostatnim czasie zauważa się szczególnie intensywne dysputy na temat współzależności określania osoby posiadającej wiadomości specjalne z jej statusem w postępowaniu przygotowawczym. Dyskusji poddawane są też zagadnienia współpracy podmiotów postępowania przygotowawczego w kontekście międzynarodowym. Mniej aktywny (ale nie mniej istotny) dyskurs dotyczy formy i specyfiki współpracy funkcjonariuszy dochodzeniowo-śledczych i specjalistów oraz biegłych w trakcie badania czynów przestępczych. Mając na uwadze duże praktyczne znaczenie oraz istniejące różnice w traktowaniu naukowym tej problematyki, za cel niniejszego badania obrano formy i treść współpracy funkcjonariuszy organów ścigania ze specjalistami (biegłymi) z laboratoriów kryminalistycznych, a także problemy wynikające z tej współpracy oraz kierunki jej usprawniania. W pierwszej części artykułu przytoczono wybrane poglądy na definicje osoby posiadającej wiadomości specjalne funkcjonujące na Litwie ** i w niektórych innych państwach. Zdaniem autorów, unifikacja (harmonizacja) różnych pojęć (definicji), terminów i statusu dotyczącego biegłego, specjalisty i wiadomości specjalnych powinna być jednym z celów działań w realizacji wizji wspólnej europejskiej przestrzeni kryminalistycznej 2020. Wymaga to przeprowadzenia poważnej analizy standardów w dziedzinie prawa oraz zarządzania w stosowaniu wiadomości specjalnych każdego państwa *** . W części drugiej, popartej wynikami badań empirycznych, omówiono praktyczne problemy współpracy funkcjonariusza organów ścigania i specjalisty (biegłego), przeanalizowano trzy podstawowe formy ich współpracy oraz przed- List do Redakcji Letter to Editor archiwum medycyny sądowej i kryminologiiCopyright © 2016 by PTMSiK *W artykule zamiennie są stosowane pojęcia "funkcjonariusze pionu dochodzeniowo-śledczego", "funkcjonariusze organów ścigania" i "dochodzeniowcy". **Funkcjonujący na Litwie od roku 2003 k.p.k. wymienia dwie podstawowe figury procesowe stosujące wiadomości specjalne, a mianowicie: eksperta (biegłego) sądowego i specjalistę. Biegły jest powoływany przez sąd w procesie rozprawy, a do ustalania okoliczności sprawy wymagających wiadomości specjalnych w postępowaniu przygotowawczym powoływany jest przez prokuratora lub funkcjonariusza organów ścigania specjalista. Specjalistą według ustawodawstwa litewskiego jest nie tylko pracownik komórki techniki kryminalistycznej policji (odpowiednik polskiego technika kryminalistyki), lecz także pracownik laboratorium kryminalistycznego, który został powołany do udziału w czynnościach dochodzeniowo-śledczych w postępowaniu przygotowawczym, jak również inna osoba posiadająca wiadomości specjalne.
